MATTERS FOR RECOMMENDATION TO THE COUNCIL
LA 10/029 Licensing Act 2003: Review of Statement of Licensing Policy
The report of the Central Services Director set out details of the proposed consultation process for the review of the Council's Statement of Licensing Policy. The report highlighted the timetable for the consultation and set out details of those persons/bodies to be included in the process.

RECOMMENDED: That the Council

(1) adopt the draft revised Statement of Licensing Policy set out in Annex 1 to the report for consultation purposes; and

(2) confirm the action taken to commence consultations prior to approval of the draft statement by Council.

LA 10/030 Application for Increase in Table of Maximum Hackney Carriage Fares
The report of the Central Services Director set out details of applications for a review of the tariff of maximum fares received from a taxi driver and a taxi business proprietor. A number of Members expressed concern that the information within the report did not provide a coherent picture of the current position, particularly in comparison to neighbouring Licensing Authorities, or sufficient information to determine the application.

RESOLVED: That determination of the applications be deferred to the next meeting of the Licensing and Appeals Committee.
LA 10/031 Taxi and Private Hire Policy
Further to Minute LA 09/050 of the meeting of the Committee held on 14 December 2009, the Central Services Director set out details of the Best Guidance issued by the Department of Transport which had informed the review of the licensing policy for Hackney Carriage and Private Hire Licensing. Members' attention was drawn to the ongoing consultation with the trade in respect of vehicle testing and to the proposed introduction of a 'penalty point' system to assist in the enforcement of both driver and operator licences.

RESOLVED: That

(1) the draft Statement of Hackney Carriage and Private Hire Licensing Policy set out in Annex 1 to the report be endorsed for consultation with stakeholders; and

(2) a further report be submitted to the next meeting of the Licensing and Appeals Committee.
MATTERS SUBMITTED FOR INFORMATION
LA 10/032 Update on the Implications of S.27 of the Policing and Crime Act 2009 on the Licensing Act 2003
The Central Services Director outlined the powers available to licensing authorities under Section 27 of the Policing and Crime Act 2009 in respect of the regulation of a 'sex entertainment venue'. The report outlined the process for the adoption of these new powers which would allow local authorities to regulate lap dancing and similar venues.

RESOLVED: That the report be received and noted.
