C 07/051 Minutes
RESOLVED: That the Minutes of the proceedings of the Statutory Annual Meeting of the Council held on 15 May 2007 be approved as a correct record and signed by the Mayor.
C 07/052 Mayor's Announcements.
The Mayor advised that she had undertaken fifty engagements in the last couple of months and she thanked the Deputy Mayor for attending a further ten events on her behalf. She made particular reference to the 'Tour de France' on 8 July and congratulated everyone involved in producing such a splendid event.

Amongst her recent programme of events she mentioned her Civic Service at All Saints Church, Birling on 3 June and the River Cruise on 16 June.

She invited Members' support at the annual cricket match against Maidstone Borough Council on 12 August, the charity performance of 'Blue Planet Live' on 26 August, her Garden Party on 13 September, the 'Mauling Cup' golf competition on 16 September and a Jazz and Dinner Evening at Poult Wood Golf Centre on 19 October.
C 07/053 Questions from the public pursuant to Council Procedure Rule No 5.6
The Council considered a question submitted by Mr G Rowe pursuant to Council Procedure Rule No 5.6. Details of the question regarding the provision of flood protection measures in Aylesford and the response of the Cabinet Member for Planning and Transportation were circulated at the meeting.

C 07/055 Notices of Motion submitted pursuant to Council Procedure Rule No 5.18
The following Notice of Motion was proposed by Councillor Lettington and seconded by Councillor Clements subject to the amendment proposed by Councillor Worrall and seconded by Councillor Dobson:-

"Members of the Tonbridge and Malling Borough Council support the aims of the Kent Joint Municipal Waste Strategy and the principles of "reduce, re-use, recycle." Consequently, the Council welcomes the aspirations expressed in Early Day Motions 1370 and 814, urging a reduction, where possible, in packaging on goods sold, encouraging the re-use of plastic bags and the recycling of packaging waste. The Council commends the encouragement of suppliers to reduce packaging further up the supply chain, and the provision of free of charge collection points for packaging materials sold or supplied, which should be recycled or disposed of safely."

"That this House notes with concern the excessive levels of packaging used by manufacturers and retailers; urges supermarkets to reduce packaging, to encourage the re-use of plastic bags, to recycle packaging waste and to encourage suppliers to reduce packaging further up the supply chain; and believes that, to further those objectives, retailers should be required to provide free of charge a collection point for any packaging materials sold or supplied by them and should be required to recycle them or safely to dispose of such materials."

RESOLVED: That the Motion be agreed.
C 07/056 Leader's Announcements.
The Leader opened his announcements with a request that a vote of thanks be recorded for the assistance provided by officers throughout the Member Induction process.

He echoed the Mayor's comments on the success of the 'Tour de France' on 8 July and paid tribute to all the officers involved. He reminded Members that Tonbridge Castle was scheduled to host another major event the following weekend with the Festival of Music and Fireworks.

The Leader was pleased to announce that Southern Water had abandoned its appeal against refusal of planning permission for the sludge treatment plant at Eccles and he paid tribute to the opposition led by the local Members and the Council's officers.

The Leader advised that meetings with the Council's Registered Social Landlord partners would be held in September, October and November and that the relevant Members would be provided with details of the arrangements in due course. He further advised that Claire Martin of Kent County Council would be attending the meeting of the Strategic Housing Advisory Board on 8 October 2007 to receive views on the County Council's proposals on services provided to elderly people in sheltered housing schemes.

The Leader reported that the launch of West Kent's Neighbourhood Policing had been held at West Kent College on 5 July 2007.

He paid tribute to the work of the Friends of Tonbridge Cottage Hospital and the Members and officers of this Authority which had ensured that this facility would not be closed.

The Leader invited Members to join him in congratulating Sevenoaks District Council in achieving a CPA reclassification as an Excellent authority.

He referred to the significant development of Tonbridge Town Centre, at Peter's Pit, Wouldham and at Leybourne Grange and stated that development partners should be encouraged to engage with the local communities as details of these developments were formulated.

The Leader reported that the Electoral Administration Act 2006 required local authorities to undertake a review of polling districts and polling places by December 2007 and he advised that meetings of the Electoral Review Working Group would be held on 15 August and 15 November 2007.

The Leader advised that a Special meeting of the Council would be held on 7 August to consider the awarding of Honorary Aldermanship or Freemanship to former Members of the Council.

The Leader invited Members to join him in congratulating Jonathon Shaw MP on his promotion to a Ministerial post within DeFRA and his dual appointment as Regional Minister for the South East.

Finally, the Leader reminded Members that the first meeting of the Joint Local Board would be held on 12 July and that it would be considering the issue of tackling climate change.

C 07/062 Amendments to the Council's Constitution
The Monitoring Officer presented details of amendments required to the Constitution in respect of the Severance of Motions; the Appointment of a second Vice-Chairman for any committee or sub-committee and the Council's functions relating to smoke-free premises. Members were advised that the regulations relating to smoke-free premises were not the responsibility of an authority's executive but could fall within the purview of the General Purposes Committee rather than the Licensing and Appeals Committee as stated in the report. It was noted that, as stated at Annual Council, Councillor Mrs Simpson would be the second Vice-Chairman of Area 3 Planning Committee.

RESOLVED: That

(1) the alterations to the Council's Constitution referred to in the report, as amended at the meeting, be adopted; and

(2) the Monitoring Officer be authorised to make any necessary consequential amendments.
C 07/063 Appointments to Committees and Outside Bodies
Further to Minutes C 07/045 and C 07/046 the report of the Central Services Director provided an update on the position concerning the appointment to vacancies remaining on committees and outside bodies after the Annual Council Meeting held on 15 May 2007.

RESOLVED: That

(1) the appointment of Councillor Ms J Atkinson to Age Concern (Tonbridge) be confirmed;

(2) Councillor Ms V Branson be appointed to serve on the Tonbridge Volunteer Bureau;

(3) Councillor N Heslop be appointed to serve on the Twinning Committee; and

(4) the remaining three vacancies on the Twinning Committee be filled with the agreement of the Group Leaders.

RESOLVED: That authority be given for the Common Seal of the Council to be affixed to any instrument to give effect to a decision of the Council incorporated in these Minutes and proceedings.
