C 05/041 Declarations of interest.
There were no declarations of interest made.
C 05/042 Planning Application TM/05/00608 - 5 Premier Parade, Aylesford
Consideration was given to the report of the Director of Planning and Transportation in relation to an application for the change of use of 5 Premier Parade from Use Class A1 (retail) to Use Class A5 (sale of hot food) which had been referred to the Council for determination in accordance with Council and Committee Procedure Rule 15.24 by Area 3 Planning Committee at its meeting on 23 June 2005.

In order to facilitate the proper consideration of Planning Application TM/05/00608/FL the Council agreed to suspend its own procedure rules and adopt the Committee procedure rules.

The following speakers addressed the meeting where the required notice had been given and their comments were taken into account by the Council when determining the application:-

In reaching their decision Members of the Council also had regard to the reports considered by Area 3 Planning Committee at the meetings held on 26 May and 23 June 2005, the written comments submitted by Councillor Rowe and the report of the Chief Solicitor which contained exempt information (LGA 1972 Sch 12A Para 12 - Legal Advice).

RESOLVED: That Planning Permission be

REFUSED for the following reason:

1. The introduction of a third hot food take-away use would result in such uses being over-dominant in this small parade of shops, which is within an otherwise residential area and some distance from other retail facilities. Because of the pattern of use commonly associated with hot food take-aways, and the perceived impacts on the environment and quality of life of local residents, this would be likely to have a harmful effect on local amenities and undermine the intended role and function of the Parade as a neighbourhood shopping centre, to the detriment of the overall wellbeing of the community.
C 05/043 Tonbridge Swimming Pool - Outdoor Pool Remedial Works
The joint report of the Director of Leisure and the Cabinet Members for Leisure Facilities, Culture and Youth and for Resources and Capital Projects summarised the consideration given by the Leisure Facilities Culture and Youth Advisory Board to the options for remedial works at the outdoor pool of Tonbridge Swimming Pool to be undertaken during the autumn/winter closure period.

RESOLVED: That

(1) remedial repair option 4 recommended by S & P Ltd (remove the existing marbeline finish, screed and render back to the existing pool concrete shell, apply new render and screed and apply new ceramic tiling) be approved;

(2) the consultant team outlined in the report be appointed, and S & P Ltd be requested to undertake the tendering of the building contract on the Council's behalf;

(3) authority be delegated to the Director of Leisure and the Director of Finance in liaison with the relevant Cabinet Members to appoint the building contractor and award the building contract;

(4) the remedial works be progressed in accordance with the timescale outlined in the report;

(5) the cost of the short-term repair works at £4,500 be met from the Council's Building Repairs Reserve;

(6) the Leisure Contracts Manager be requested to determine the loss of income resulting from the closure of the outdoor pool and, following liaison with the Director of Finance, a report be submitted to the next meeting of the Leisure Facilities, Culture and Youth Advisory Board; and

(7) the cost of the remedial repair works at £186,000 be met from the Council's Revenue Reserve for Capital Schemes, with the project being brought forward to List A of the Capital Plan on an exceptional basis.
C 05/044 Restrictions on the Consumption of Alcohol in Public Places
The joint report of the Chief Executive and the Cabinet Member for Community Development assessed the implications of designating an area of Snodland Town Centre, under powers contained within Sections 12-16 of the Criminal Justice and Police Act 2001, as a place where restrictions on the consumption of alcohol in public places would apply.

RESOLVED: That

(1) the Council makes an Order, pursuant to the Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2001, to designate the area outlined on the map of Snodland Town Centre attached at Annex 1 to the report as an area where restrictions apply to the consumption of alcohol in a public place; and

(2) the Crime and Disorder Reduction Partnership be requested to monitor the operation and effectiveness of the Order and submit a report to the Community Development Advisory Board after twelve months operation of the Order.
