LA 05/007 Minutes
RESOLVED: That the Minutes of the meeting of the Licensing and Appeals Committee held on 4 April 2005 be approved as a correct record and signed by the Chairman.
DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
LA 05/008 Hackney Carriage Table of Maximum Fares
The Chief Solicitor reported that the table of maximum hackney carriage fares adopted by the Committee on 4 April 2005 had been subject to public consultation and, as there were no objections raised, the table had come into effect on 4 May 2005.

RESOLVED: That the Cabinet Member for Resources and Capital Projects and the Chairman and Vice-Chairman of the Committee, together with the Chief Solicitor and the Licensing Manager, be authorised to meet with representatives of the trade early in the New Year.
LA 05/009 Vehicles (Crime) Act 2001: Licensing of Motor Salvage Operators
The Chief Solicitor submitted a report from the Head of Trading Standards as to the operation of the licensing regime within the Borough. He also reported that the Council's agency agreement with Kent County Council was about to expire and that the County Council had asked for it to be renewed.

RESOLVED: That

(1) the agency agreement with Kent County Council be renewed for a further term of one year, subject to the proviso that the County Council provide the Borough Council with an annual report as to the action taken under the agency agreement; and

(2) the Kent County Council be advised that, subject to satisfactory performance under the renewed agency agreement, the Borough Council is minded to grant a further agency agreement.
LA 05/010 Zoo Licensing Act 1981: Hop Farm Country Park
The Chief Solicitor reported that the Hop Farm Country Park had a number of small animals, namely tortoises and iguana, which required it to hold a zoo licence. However, on the advice of DEFRA, it was possible to apply to the Secretary of State for an exemption from this requirement.

RESOLVED: That, subject to written confirmation from the owner that he would notify the Council of any significant changes to the number of animals kept and any change in the species of animals kept, the Chief Solicitor be authorised to apply to the Secretary of State for a dispensation under Section 14 of the Zoo Licensing Act 1981 in respect of the Hop Farm Country Park.

LA 05/011 Partnership Working with the Health and Safety Executive
The Director of Health and Housing reported on the Council's activity under its partnership arrangements with the Health and Safety Executive. This included information on initiatives relating to manual handling, "Backs! 2005 Campaign", and to slips and trips, "Watch Your Step".

RESOLVED: That the report be received and noted.
LA 05/012 Health and Safety Enforcement Plan - Outturn Report 2004/05
The Director of Health and Housing reported on the Council's activity under its Health and Safety Enforcement Plan for the year 2004/05. This included information about inspections undertaken, enforcement and other activity together with a summary of the action proposed under the Plan for the future.

RESOLVED: That the report be received and noted.
LA 05/013 Service of Statutory Notices
The Director of Health and Housing reported on notices served under the Health and Safety at Work etc Act 1974 since the last report to Members.
