Housing Act 2004: Licensing of Houses in Multiple Occupation |
The report of the Chief Solicitor set out details of the licensing requirements and the administrative implications of the introduction of mandatory licensing of houses in multiple occupation under the provisions of Part 2 and 3 of the Housing Act 2004. The Committee noted that the licensing regime would be effective from 6 April 2006 but that the enforcement provisions would not come into effect until 3 July 2006. RECOMMENDED: That (1) authority be delegated to the Chief Solicitor to determine unopposed applications for HMO licences and that opposed applications be considered by the Licensing and Appeals Committee, sitting as a panel; and (2) the appropriate amendments to Part 3 of the Council's constitution be authorised. *Referred to Council |

Hackney Carriage Table of Maximum Fares |
The report of the Chief Solicitor set out details of a request received from the Tonbridge and Malling Licenced Drivers Association that the Council's table of maximum fares be varied to allow charging for both 'time and distance'. A number of Members expressed concern about the implications of amending the tariff to include a charge for the time spent in a Hackney Carriage in an area where a large number of road improvement schemes were planned. It was suggested that further advice should be sought from the Department of Transport and the national association for hackney carriage operators regarding the benefits and disbenefits of adopting the proposed tariff. RESOLVED: That (1) the current table of maximum fares be retained at present; and (2) this issue be reviewed in twelve months time and advice be sought from the Department of Transport and the appropriate national association on the implications of introducing a charge for 'time and distance'. |

Designation of New Taxi Rank in Barden Road, Tonbridge |
The Chief Solicitor's report reminded Members that the Tonbridge Local Parking Plan included the provision of an additional taxi rank at Barden Road, Tonbridge. He advised the Committee of the process involved in the designation of the new rank within regulations made by the Council under Section 63 of the Local Government (Miscellaneous Provisions) Act 1976. RESOLVED: That (1) the proposal to create an additional taxi rank in Barden Road, Tonbridge, be supported; and (2) the Chief Solicitor be authorised to conduct the public consultation process and, if there are no objections, to make the necessary regulations. |
