AP1 12/001 Declarations of interest.
Councillors Mrs Anderson, Baldock, M Davis and C Smith declared a personal and prejudicial interest in application TM/11/02838/FL on the grounds of their close association with the landowner who was a former councillor. In addition, Councillor Davis declared a further personal and prejudicial interest on the grounds that his firm of solicitors acted for the landowner.

Councillor N Heslop declared a personal interest in the same application on the grounds of his close association with the landowner.

Councillor Miss Sergison declared a personal interest on the grounds of being a member of the Tonbridge Rotary Club with the landowner.

Councillor Trice declared a personal interest in application TM/11/02785/FL on the grounds that a family member lived opposite the development site.

Councillor M Davis declared a personal and prejudicial interest in application TM/11/02794/FL on the grounds that his firm of solicitors acted for the applicant.

AP1 12/003 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or in the variations indicated below. Any supplementary reports were tabled at the meeting.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.
AP1 12/004 TM/11/02838/FL - 187 Hadlow Road, Tonbridge
Demolition of existing 4 bed house and erection of a new block of flats containing 6 x 2 bed flats plus parking for 6 vehicles at
187 Hadlow Road, Tonbridge.

RESOLVED: That the application be

REFUSED for the following reason:

1. The proposed development, by virture of hits siting, overall size, bulk, massing and the specific relationship with 189 Hadlow Road, would result in an unacceptable overbearing impact on that property, to the detriment of the residential amenities currently enjoyed by its occupants. Additionally, the size, bulk and massing of the development would have a detrimental visual impact on the street scene and wider locality. As a result, the Local Planning Authority considers that the site is unable to accomode the proposed development in a satisfactory manner, contrary to national planning guidance in Planning Policy Statement 3: Housing, Policies CP1 and CP24 of the Tonbridge and Malling Core Strategy and Policy SQ1 of the Tonbridge and Malling Managing Development and the Environment Development Plan Document 2010.

Informative:

1. The Local Planning Authority would suggest that the site and locality is not appropriate for flatted development and that family housing at an appropriate density and scale would be a more appropriate option in this location.

AP1 12/005 TM/11/02545/FL - Land South East of Gracelands, Nizels Lane, Hildenborough
Removal of Condition 10 of planning permission TM/06/01849/FL and Condition 5 of planning permission TM/08/01904/FL to allow the stables and sand school to be used for commercial purposes at land south east of Gracelands, Nizels Lane, Hildenborough.

RESOLVED: That the application be

APPROVED in accordance with the submitted details set out at paragraph 7.1 of the report of the Director of Planning, Transport and Leisure, subject to

(1) The conditions, reasons,and informatives as set out in the report of the Director of Planning, Transport and Leisure;

(2) Amended Condition:

3. The sand school shall be used only to exercise and/or teach those horses stabled at the livery stables permitted at the site or grazed on the land hatched on the attached site location plan hereby approved.

Reason: To ensure that there is not an over intensive use of the premises that could harm the amenities of the locality and the free and safe flow of traffic on local highways.
AP1 12/006 TM/11/02785/FL - 56 Greentrees Avenue, Tonbridge
Demolition of existing garage and construction of replacement detached garage at 56 Greentrees Avenue, Tonbridge.

RESOLVED: That the application be

APPROVED in accordance with the submitted details set out at paragraph 7.1 of the report of the Director of Planning, Transport and Leisure, subject to:

(1) The conditions, reasons and informatives as set out in the report of the Director of Planning, Transport and Leisure; and

(2) Addition of informative:

AP1 12/007 TM/11/02794/FL - Fosse Bank School, Noble Tree Road, Hildenborough
Variation of planning conditions 1 and 4 of permission TM/10/03297/FL for the erection of a marquee to hold weddings and evening receptions and for educational use, to allow for a permanent siting of the marquee and to allow for 6 extensions of time to 1am each year at Fosse Bank School, Noble Tree Road, Hildenborough.

RESOLVED: That the application be

APPROVED in accordance with the submitted details set out in paragraph 7.1 of the report of the Director of Planning, Transport and Leisure, subject to:

(1) The conditions, reasons and informatives set out in the report of the Director of Planning, Transport and Leisure;

(2) Delete Condition 1.

(3) Amended Conditions:

1. No music and speech generated within the marquee shall be audible beyond the site boundary as shown on plan TMBC 1 attached to this decision.

Reason: In the interest of residential amenity.

3. The hours specified in Condition 2, may be extended from 23.30 hours to 01.00 hours on no more than 6 occasions during any calendar year on any day, with the exception of Sunday night to Monday morning. At least 14 days notice shall be given to the Local Planning Authority of the intention to operate beyond 23.30 hours on each separate occasion.

Reason: In the interests of residential amenity.

(4) Additional Condition:

4. The site should be entirely vacated by all guests no later than 1 hour after the times specified by Conditions 2 and 3 of this planning permission.

3. Notwithstanding the provisions of Condition 3, the applicant is encouraged to provide a list of those events that are covered by the condition to the Local Planning Authority as soon as they are known.
