Councillor Ms Branson declared an Other Significant Interest in application TM/13/02727/FL in that a friend lived in a property which adjoined the application site. Having made a personal statement she withdrew from the meeting during consideration of this item.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Housing and Environmental Health, or in the variations indicated below. Any supplementary reports were tabled at the meeting.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.
AP1 13/043 (A) TM/13/02514/FL and (B) TM/13/02569/RD - 65 Hadlow Road, Tonbridge
(A) Variation of condition 7 of planning permission TM/09/02728/FL to allow for safety glazing inside the outward opening doors serving bedrooms and a bathroom at second floor level
(B) Details of privacy screen serving sun terrace submitted pursuant to condition 8 of planning permission TM/09/02728/FL at 65 Hadlow Road, Tonbridge.

RESOLVED: That

(1) Application (A) TM/13/02514/FL be

REFUSED for the following reason:

1. The provision of outward opening doors and internal safety barriers at second floor level would result in a perceived loss of privacy detrimental to the residential amenities of the neighbouring property and furthermore represents an unsightly solution detrimental to the appearance of the host dwelling, contrary to saved policy P4/12 of the Tonbridge and Malling Borough Local Plan 1998.

(2) Application (B) TM/13/02569/RD be

REFUSED for the reason set out in the report of the Director of Planning, Housing and Environmental Health.

Retrospective Application: Demolition of garage. Erection of part single, part two storey rear extension, single storey side extension and creation of raised terrace in rear garden being a revised scheme to that approved under ref: TM/12/03489/FL at 56 Dry Hill Park Road, Tonbridge.

RESOLVED: That the application be

APPROVED in accordance with the submitted details, conditions and informatives set out in the report of the Director of Planning, Housing and Environmental Health subject to the addition of condition:

2. The use shall not be commenced, nor the premises occupied, until a minimum of two vehicle parking spaces have been provided, surfaced and drained. Thereafter it shall be kept available for such use and no permanent development, whether or not permitted by the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking or re-enacting that Order) shall be carried out on the land so shown or in such a position as to preclude vehicular access to this reserved parking space.
Reason: Development without provision of adequate accommodation for the parking of vehicles is likely to lead to hazardous on-street parking.

AP1 13/045 TM/13/02172/FL - 335-337 Shipbourne Road, Tonbridge
Construction of two replacement dwellings on frontage and detached garage to rear (to serve detached dwelling approved under planning ref TM/09/00951/FL) at 335 - 337 Shipbourne Road, Tonbridge.

RESOLVED: That the application be

APPROVED in accordance with the submitted details, conditions and informatives set out in the report and supplementary report of the Director of Planning, Housing and Environmental Health subject to

(1) the amendment of condition 13 as follows:-

13. No development shall take place, other than the demolition of the existing dwellings, until there has been submitted to and approved by the Local Planning Authority a scheme of hard and soft landscaping and boundary treatment. All planting, seeding and turfing comprised in the approved scheme of landscaping shall be implemented during the first planting season following occupation of the buildings or the completion of the development, whichever is the earlier. Any trees or shrubs removed, dying, being seriously damaged or diseased within 10 years of planting shall be replaced in the next planting season with trees or shrubs of similar size and species, unless the Authority gives written consent to any variation. Any boundary fences or walls or similar structures as may be approved shall be erected before first occupation of the building to which they relate.
Reason: To ensure that the development does not harm the visual amenities of the locality.

(2) the addition of Conditions:

16. The windows serving the stairwells of both dwellings hereby approved shall be fitted with obscured glass and, apart from any top-hung light shall be non-opening. This work shall be effected before the relevant dwelling is occupied and shall be retained thereafter.
Reason: To minimise the effect of overlooking onto neighbouring properties.

17. Notwithstanding the provisions of Article 3 of the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order), no windows or similar openings shall be constructed at first floor level in any elevation of the buildings other than as hereby approved, without the prior written consent of the Local Planning Authority.
Reason: To enable the Local Planning Authority to regulate and control any such further development in the interests of amenity and privacy of adjoining property.

(3) the addition of Informatives:

6. In seeking to formally discharge Condition 13, the applicant should be aware that the vehicle parking spaces, turning areas and access road should be constructed of porous materials or provision made to direct run-off water from the hard surface to a permeable or porous area or surface within the application site. Further guidance can be found under 'Guidance on the Permeable Surfacing of Front Gardens' produced by the Environment Agency.

7. In seeking to formally discharge Condition 13, the applicant is strongly discouraged from incorporating Leylandii hedges into the proposed landscaping scheme and should note the requirements of Condition 9 being that any gateway to the access must be set back 5.0m from the edge of the highway.

Construction of new single storey additions and alterations to front elevation at 152-154 Tonbridge Road, Hildenborough.

RESOLVED: That the application be

DEFERRED to allow for further consideration of the impacts on residential amenity arising from the scale of the proposed use, the provision of more detailed information regarding how the use is proposed to operate and the proposed design.

RESOLVED: That an Enforcement Notice BE ISSUED, the detailed the wording of which to be agreed with the Director of Central Services, requiring the cessation of the unauthorised use and the removal of all associated unauthorised equipment.
