Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or in the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.

Demolition of existing bungalow and erection of replacement house with detached garage (revised design to that approved by TM/09/01505/FL)at Sunny View, Green Lane, Trottiscliffe.

RESOLVED: That the application be

APPROVED, subject to:-

(1) The conditions set out in the main report of the Director of Planning, Transport and Leisure.

(2) Additional condition:

14. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order), no development shall be carried out within Class A, of Part 1 of Schedule 2 of that Order unless planning permission has been granted on an application relating thereto.

Reason: To safeguard the amenity of the locality.

(3) Additional informatives:

1. Owing to the likelihood of the existing buildings containing or being constructed of asbestos products, prior to demolition an Asbestos Survey should be conducted in order to manage the risk from asbestos and to comply with current health and safety legislation. Any asbestos found on site must be removed in a controlled manner by an appropriately qualified operator and written approval regarding survey and removal obtained from the Director of Health and Housing, Tonbridge and Malling Borough Council, Gibson Building, Gibson Drive, Kings Hill, West Malling, Kent ME19 4LZ. 2. The applicant is advised that Green Lane is a ‘Quiet Lane' and that noise, disruption, danger and damage by construction traffic should be minimised by:

~ restricting deliveries to between 0730 and 1830 hours, weekdays only and avoiding times busy for school departures and arrivals;
~ consideration in minimising reversing manoeuvres onto the Lane and public highway;
~ all construction related to parking and all unloading to be restricted to the application site;
~ sizes of construction-related vehicles being limited to those appropriate to the narrowness of the Lane;
~ wheel washing facilities being provided on site; and
~ any damage to the surface of the Lane caused as a result of construction activities being made good.

(1) Referral to the Secretary of State being a departure from the Development Plan;

(2) The applicant entering into an agreement under Section 106 of the Town and Country Planning Act 1990 (as amended) to include strategies for: -

~ investment in public golf development and facilities, minimising the amenity impact (visual prominence, noise, odours, fumes, light pollution) on the locality from the size of the building, servicing and large events and functions;

9. Prior to the commencement of development, a scheme of external lighting shall be submitted to and approved by the Local Planning Authority. The scheme shall include details of:

~ the location, specification, height above ground and area to be illuminated by each external light to be installed within the site, whether freestanding or attached to a building; and
~ how the scheme addresses the recommendations made in the Ecological Scoping Survey submitted as part of the application.

No external lighting shall be installed other than in accordance with the approved scheme.

Reason: To protect the character of the area, Green Belt and amenities of neighbouring dwellings and in the interests of local biodiversity.

12. The works to the Blue Bell Inn hereby permitted shall be completed within 3 months of the first occupation of the hotel accommodation hereby permitted. Thereafter, the hotel accommodation shall only be operated in conjunction with the operation of the Blue Bell Inn itself as a public house (Use Class A4). If the Blue Bell Inn ceases trading for a period of 2 months or longer, then the Local Planning Authority shall be informed in writing, and detailed proposals and timetable for the ongoing management and operation of the site as a whole shall be submitted for the approval of the Local Planning Authority. The ongoing management and operation proposals shall be undertaken as approved.

Reason: In recognition of the exceptional circumstances under which planning permission has been granted for this development, which would otherwise have been regarded as unacceptable in terms of Green Belt policy.
