DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
AP2 11/026 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or in the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.
AP2 11/027 TM/10/01731/FL - Queens Head, 133 Butchers Lane, Mereworth
Variation of condition 8 of planning consent TM/99/02352/FL to allow outside seating on patio area with erection of an enclosure of fence/gate at Queens Head, 133 Butchers Lane, Mereworth.

RESOLVED: That the application be

APPROVED, subject to the following: -

(1) Amendment to condition:
1. Prior to the introduction of tables and chairs to the side patio:

(a) 1.8m high palisade/trellis fence with trellis returns of 0.9m high shall be erected in accordance with the details hereby approved and shall be retained thereafter, and

(b) The fence shall be landscaped in accordance with details received on 1 April 2011 and as hereby approved and the approved scheme shall be retained thereafter.

Reason: In the interests of residential amenity.

(2) as per the conditions, reasons and informative set out in the report of the Director of Planning, Transport and Leisure.

AP2 11/028 (A) TM/10/03410/FL & (B) TM/10/03036/FL - 2 Keepers Cottage, Hurst Wood, Platt
(A) Single storey side extension and retention of wall at 2 Keepers Cottage, Hurst Wood, Platt.

(B) Use of part ground floor and first floor of existing detached building as annexe at 2 Keepers Cottage, Hurst Wood, Platt.

RESOLVED: That

Application (A) be REFUSED for the following reason: -

(1) The proposed extension, taken together with previous extensions to the property, will result in a disproportionate addition over and above the size of the original building. The proposed development will therefore constitute inapproprite development with the Green Belt, which is contrary to Policy CP3 of the Tonbridge and Malling Borough Core Strategy, and the advice offered in PPG2: Green Belts; and

(2) Addition of informative:
1. The applicant is advised that permitted development rights the erection of extensions, porches and outbuildings at the site were removed by Condition 4 of planning permission reference TM/88/0176 and any further proposals to undertake such works will require planning permission following the submission of a planning application.


RESOLVED: That Application (B) be REFUSED for the following reason:

(1) The proposed use of the building as shown on the submitted plans and supporting information would include the provision of primary accommodation. The Local Planning Authority considers that this proposed use would not be for a purpose which is genuinely incidental and ancillary to the enjoyment of the dwelling house and therefore comprises inappropriate development in the Metropolitan Green Belt which is contrary to Policy CP3 of the Tonbridge and Malling Borough Core Strategy, and PPG2: Green Belts; and

(2) Addition of informative:
1. The applicant is advised of the requirements of the Enforcement Notice which applies to the building located to the south of the dwelling house: that the building shall not be used as a family dwelling house and there shall be no kitchen or associated fixtures and fittings and no beds or other furniture designed for sleeping within this building.

RESOLVED: That

(1) the report of the Director of Planning, Transport and Leisure be noted;

(2) that the requirements, as set out in the report of the Director of Planning, Transport and Leisure, and the concerns raised by Members regarding noise attenuation measures be resolved within the planning obligation as envisaged by Minute AP2 11/018 (2) of 2 March 2011; and

(3) The detailed wording of the final agreement be delegated to the Director of Planning, Transportation and Leisure to determine.
