RESOLVED: That the Minutes of the meeting of Area 2 Planning Committee held on Wednesday 16 August 2006 be approved as a correct record and signed by the Chairman, subject to the amendment of Minute AP2/06/119 related to 05/00088/UNAWKS, land south west of 1-4 Dutts Cottages, Teston Road, Offham to read as follows: "However, the enforcement notice not to take effect for 3 months".

Change of use (part retrospective) of land and buildings as Equine Training establishment, and use of 4 no. timber loose boxes for the stabling of horses in association with the use of Puttenden Manor as a dwelling, with access from Puttenden Road at
Puttenden Manor, Puttenden Road, Shipbourne.

RESOLVED: That the application be

(1) REFUSED and

(2) an Enforcement Notice ISSUED and SERVED on all interested parties. The Notice to take effect not less than 28 days from the date of service, subject to:
~ the concurrence of the Chief Solicitor, he being authorised to amend the wording of the Enforcement Notice as necessary;
~ in the event of an appeal against the Notice, the Secretary of State and the appellant to be advised that the Local Planning Authority is not prepared to grant planning permission for the development the subject of the Enforcement Notice.
(3) In the event of the Enforcement Notice not being complied with and subject to satisfactory evidence, the Chief Solicitor BE AUTHORISED to commence any proceedings which may be necessary under Section 179 of the Town and Country Planning Act 1990 (as amended) to secure compliance with the Enforcement Notice.

Redevelopment to provide integrated highway depot compromising offices, garaging, salt barn and storage areas with associated car parking and landscaping at

RESOLVED: That NO OBJECTIONS be raised, subject to the following:
(1) It is considered that HGVs should not be permitted to make a right turn exit from the site in the interests of highway safety and the free flow of traffic.
(2) the County Council is asked to consider whether changes could be made to the design of the upper part of the south-west elevation of the office block, in the interests of privacy of neighbouring residential properties yet retaining an adequate internal environment to the office and to the salt barn's height and design such that it be more traditional in appearance and therefore more in keeping with the locality.
(3) The County Council is asked to impose appropriately worded conditions to secure compliance with the Travel Plan and with noise, air quality and light pollution mitigation as detailed in the application's supporting documents. The Travel Plan should be the subject of early consultation with TMBC and Wrotham Parish Council.
(4) All external materials should be subject of early consultation with TMBC and should be as subdued as possible to minimise visual prominence in longer distance views within the Area of Outstanding Natural Beauty.
(5) All possible steps should be taken to avoid the risk of contamination of local water courses by salt, road scalpings, surfacing and other materials - the County Council is asked to review this matter further with the EA.
(6) The County Council is asked to engage in early discussion with Wrotham Parish Council and local residents in order to investigate opportunities for mitigation of any detrimental impact of the development, as far as this proves possible.
AP 06/131 TM/06/01260/FL - Land To The West Of And Including 80 Western Road, Borough Green
Construction of 2 no. dwellings at land to the west of and including 80 Western Road, Borough Green.

RESOLVED: That authority be delegated to the Director of Transport and Planning to grant planning permission subject to clarification for the Director of Health and Housing as to the reasonableness of suggested condition 5(b) (acoustic protection to amenity areas and with the following: -

(1) Addition of conditions
11. The use of the annexe to House 2 hereby permitted shall be ancillary only to that of the House 2 and it shall not be occupied as a separate hereditament.
Reason: In the interests of highway safety.
12. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order) no development shall be carried out within Class A, B, C and D of Part 1 of Schedule 2 of that Order unless planning permission has been granted on an application relating thereto.
Reason: In the interests of aural amenity of the future occupants.
13. The dwellings shall not be occupied until turning facilities have been provided within the curtilage of the site and these facilities shall be retained thereafter free from any obstruction.
Reason: In order that a vehicle may enter and leave the site in a forward direction to ensure the safe and free flow of traffic.
14. Before development commences on site, details of the existing and proposed levels of the site including the finished floor levels of the houses to be erected shall be submitted to and approved in writing by the Local Planning Authority and the development shall be carried out in accordance with the approved details.
Reason: To enable the Local Planning Authority to assess adequately the impact of the development on visual and/or residential amenities.
(2) The addition of informatives:
