RESOLVED: That the application be APPROVED, subject to the following : (1) The applicant entering into a binding Planning Obligation under S106 which provides that the dwelling cannot be occupied or sold off separately from the nursery. (2) An agricultural occupancy condition being imposed. (3) Such additional conditions as the Director of Planning, Transport and Leisure shall deem appropriate. Reasons for granting permission: (1) The Local Planning Authority is satisfied that the functional test set out in PPS7 is met and that there is no alternative residential accommodation reasonably available that could fulfil this functional requirement. Given the specific nature of the business and the way it is operated the Local Planning Authority is satisfied that the principles underlying the financial test set out in PPS7 are met to a sufficient degree, in that the specialist business is well established and likely to soon become viable and thereafter remain financially sound. (2) The Local Planning Authority is satisfied that the size of the proposed dwelling is appropriate, given the particular way in which the functional requirement for an agricultural worker¡¦s dwelling arises in this instance. (3) In light of points 1 and 2 above the proposal is considered to meet the appropriate tests for the erection of new buildings in the Green Belt in accordance with the provisions of paragraph 3.4 of PPG2 ¡V Green Belts.
