AP2 05/030 Development Control
Decisions were taken on the following applications subject to the prerequisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning and Transportation, or to the variations indicated below.

Members of the public addressed the meeting where the reqired notice had been given and their comments were taken into account by the Committee when determining the applications. Speakers are listed under the relevant planning applications shown below.
AP2 05/031 TM/05/01328/CR3 - Land opposite The Ferns, north of Maidstone Road, Platt
Replacement six class primary school together with nursery class, playing field, servicing, parking and new vehicular access (KCC ref. TM/05/TEMP/0025) at land opposite The Ferns, north of Maidstone Road, Platt

RESOLVED: That KCC be advised that TMBC raises NO OBJECTION subject to the additional comments being taken into account:
1. KCC is requested to consider other highway safety improvements other than those illustrated on the submitted plan. The Borough Council believes that the proposed pedestrian crossing would not be sufficient on its own to ensure adquate pedestrian and vehicle safety.
2. Given that this is a visually prominent site, the Borough Council considers that it is important any new school building is of a very high quality of design and appearance.
3. The Borough Council would not support this proposal if it were likely to result in the closure of other local village schools since it is felt that schools are the heart and focus of rural village communities and should be retained within the villages. KCC is requested that, in the event that a decision is made on the future need for primary school places and local primary schools, that this information be provided to GOSE to take into account in the determination of the merits of the case of very special circumstances being advanced.
4. Given that this development will result in the development of the existing school and playing field sites, and that there are several other potential development sites along this A25 corridor, KCC is urged to bring forward the provision of appropriate relief roads such as the Borough Green Bypass.
5. KCC is asked to limit any permission to that solely for a primary school (with ancillary nursery) and for no other purposes in Use Class D1 - no justification has been put foward for any other use in D1 to be located in the Green Belt or in the countryside in this locality.

REFUSED: For the following reasons
1. The Local Planning Authority considers that the siting of the structure in such an open and visually prominent position within this highway verge gives rise to unacceptable harm to the character and visual amenities of this rural locality which is designated as an Area of Outstanding Natural Beauty and Special Landscape Area. Accordingly, the proposal is found to be contrary to the provisions of Policies P3/5 and P3/6 of the Tonbridge & Malling Borough Local Plan and RS1, ENV3 and ENV4 of the Kent Structure Plan.
2. The Local Planning Authority considers that the siting of the structure adversely and unacceptably obstructs highway visibility highway

1. REFUSED: for the following reason
1. The character of this part of the village, and this stretch of Borough Green Road in particular is defined by detached properties that are spaciously separated and orientated in an irregular pattern. In this context, the Local Planning Authority is not convinced that the redevelopment of this site with two dwellings could be carried out in accordance with that defined character but would instead be likely to erode the spacious setting between properties here and it would also be likely that the new dwellings would need to be arranged in a more regimented and uniform manner than the surrounding properties. In the light of the above, it is considered that the proposal is in conflict with policies P4/11 of the Tonbridge & Malling Borough Local Plan and RS1 of the Kent Structure Plan.

1. The fencing, by virtue of its design, siting and appearance, is considered to harm the character and visual amenity of the streetscene and the wider locality, which is a designated Conservation Area, Special Landscape Area and Area of Outstanding Natural Beauty. Accordingly, the development is found to be contrary to Policies RS1, ENV3, ENV4 and ENV17 of the Kent Structure Plan and policies P3/5, P3/6, P4/4 and P4/11 of the Tonbridge & Malling Borough Council.
2. The fencing, by virtue of its design, siting and appearance, is considered to harm the setting and character of the property which is a Grade II Listed Building. Accordingly, the development is found to be contrary to Policy ENV19 of the Kent Structure Plan and policy P4/3 of the Tonbridge & Malling Borough Council.
