Councillor Chartres declared a personal and prejudicial interest in applications TM/09/00578/FL and TM/09/00588/LB in that he was a tenant of the applicant. He withdrew from the meeting during consideration of these applications.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.

AP2 09/050 TM/09/00780/FL - Walnut Tree Farm, Addington Lane, Trottiscliffe
Proposed use of land for livery purposes incorporating erection of new stables, provision of 60m X 20m manege and provision of hardstanding for access, parking and turning and septic tank at
Walnut Tree Farm, Addington Lane, Trottiscliffe.

RESOLVED: That the application be

REFUSED for the following reasons:

(1) The proposed change of use of land to commercial purposes, the construction of livery buildings and the sand school and the associated paraphernalia and activities will have a detrimental impact on the character, amenities and openness of the Green Belt and will harm the natural beauty of the Area of Outstanding Natural Beauty. The proposal is thereby contrary to current Government guidance contained within PPG2, PPS7 and policies CC6, C3 of the South East Plan 2009, CP1, CP3 and CP7 of the Tonbridge and Malling Borough Core Strategy 2007 and saved policies P6/12 and P6/13 of the Tonbridge and Malling Borough Local Plan 1998.

(2) The proposed development by reason of its size, scale, siting and location will detract from the character of the locality and harm the setting and identity of Trottiscliffe and is therefore contrary to PPS7, policy CC6 of the South East Plan, policies CP6 and CP24 of the Tonbridge and Malling Borough Core Strategy 2007 and saved policies P6/12 and P6/13 of the Tonbridge and Malling Borough Local Plan 1998.

RESOLVED: That the application be

DEFERRED until the next meeting, on 5 August 2009, for officers to seek further information from the applicants with regard to the Whole Farm Plan, full details of a strategy that would safeguard the long term viability of Mote Farm, full details of the strategy for the alternative location of the greenhouse and details of how the development relates to the long term strategy for stewardship of Ightham Mote.

Section 73A Application for detached swimming pool building (being a revised design to that permitted by TM/05/02704/FL)at
White Clouds, Taylors Lane, Trottiscliffe.

RESOLVED: That the application be

APPROVED, subject to the following: -

(1) Amend Condition 3:
3. Within 2 calendar months of the date of this permission, the roof of the pool house shall be painted with Dark Sea Grey (BS638) and this colour shall be retained thereafter.

Reason: In the interests of visual amenity.

(2) Add Condition:
4. A scheme of landscaping and boundary treatment and maintenance thereof for the north-west boundary and the rear garden of the application site shall be submitted to the Local Planning Authority for approval within 3 months of this decision. All planting comprised in the approved scheme of landscaping shall be implemented during the first planting season following the completion of the development. Any trees or shrubs removed, dying, being seriously damaged or diseased within 10 years of planting shall be replaced in the next planting season with trees or shrubs of similar size and species, unless the Authority gives written consent to any variation.

Reason: In the interest of amenity and wider landscape character.
AP2 09/054 Alleged Unauthorised Development 08/00659/UNAWKS - Woodford, Old Lane, Ightham
Alleged Unauthorised Development at Woodford Old Lane, Ightham.

RESOLVED: That

(1) An Enforcement Notice be issued as set out below and copies be served on all interested parties.

The Notice to take effect not less than 28 days from the date of service, subject to:

• The concurrence of the Chief Solicitor, he being authorised to amend the wording of the Enforcement Notice as may be necessary.

• In the event of an appeal against the Notice the Secretary of State and the appellant to be advised that the Local Planning Authority is not prepared to grant planning permission for the development the subject of the Enforcement Notice.

~ Breach Of Planning Control Alleged:

Without planning permission the construction of a red brick hard surface which is a development within its own right and being in contravention of the approved hardsurfcae as required by condition 4 of planning permission TM/07/01234/FL and approved as a hard core with porous surface under planning reference TM/08/03163/RD.

~Reasons For Issuing The Notice:

It would appear to this Authority that the above breach of planning control has occurred within the last 4 years. The current red brick surface gives the site the appearance of an urban feature within the open country side and as such detracts from the open countryside.

~Requirement:

1. To remove the redbrick hard surface and associated drainage.

2. To create the hard core and porous surface as approved by TM/08/03163/RD.

~ Period For Compliance:

Both requirements of this Notice should be complied with within one (1) calendar month of the date the Notice takes effect.

(2)Further Proceedings

In the event of the Enforcement Notice not being complied with and subject to satisfactory evidence, the Chief Solicitor be authorised to commence any proceedings which may be necessary under Section 179 of the Town and Country Planning Act 1990 (as amended) to secure compliance with the Enforcement Notice.
