RESOLVED: That the Minutes of the meeting of the Area 2 Planning Committee held on 10 July 2013 be approved as a correct record and signed by the Chairman.
MATTERS FOR RECOMMENDATION TO THE COUNCIL
AP2 13/042 Diversion of Restricted Byway MR221A, London Golf Club, South Ash Manor, Ash
The Director of Central Services reported that an application to divert Restricted Byway MR221A had been received from the London Golf Club. This was connected to a planning permission granted under reference TM/12/01290/FL to relocate an existing practice facility and access road to a previously permitted hotel development, which provided a new practice facility building and 9 hole golf course and underpass to South Ash Road. Details of the proposed diversion were set out in the plan attached to the report.

It was noted that the proposed diversions were considered necessary to allow the development proposal in application TM/12/01290/FL to be implemented and to pose acceptable changes that would improve the public rights of way network in the location.

RECOMMENDED: That

(1) the making and advertising of a Diversion Order under the provisions of Section 257 of the Town and Country Planning Act 1990 be approved; and

(2) the confirmation of the Order, if unopposed be approved; or

(3) the Order be referred to the Secretary of State for Communities and Local Government for determination if any objections are sustained.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Housing and Environmental Health, or in the variations indicated below. Supplementary reports were tabled at the meeting.

Members noted the changes to the planning history since the main report had been published and as set out in the supplementary report of the Director of Planning, Housing and Environmental Health.

RESOLVED: That Application (A) be

APPROVED in accordance with the submitted details, conditions, reasons and informatives set out in the report of the Director of Planning, Housing and Environmental Health, subject to:

(1) Amendment to Condition:

2. The garage shall not be used for any other purpose than the accommodation of private vehicles or for a purpose incidental to the enjoyment of the related dwelling house (but excluding any use as habitable accommodation) and no trade or business shall be carried on therefrom.

Reason: To safeguard the amenities and interests of occupants of other property in this residential area.

GRANTED listed building consent in accordance with the submitted details, conditions, reasons and informatives set out in the report of the Director of Planning, Housing and Environmental Health.
AP2 13/045 (A) TM/12/02140/FL & (B) TM/12/02141/LB - Former Red Lion, 45 Sevenoaks Road, Borough Green
(A) Erection of six residential dwellings and the conversion of the listed public house into two self-contained dwellings with ancillary parking and the construction of a new access drive and roundabout junction at former Red Lion, 45 Sevenoaks Road, Borough Green.

(B) Listed Building Application: Conversion of listed public house into 2 self-contained dwellings at former Red Lion, 45 Sevenoaks Road, Borough Green.

RESOLVED: That Application (A) be

APPROVED in accordance with the submitted details, conditions, reasons and informatives set out in the main and supplementary reports of the Director of Planning, Housing and Environmental Health, subject to:

(1) Additional Conditions:

14. No surface water shall drain onto the public highway.

Reason: To prevent overloading the public drainage system.

20. No more than 3 new build units hereby approved shall be occupied prior to the full completion of the restoration of the listed building in accordance with consent TM/12/02141/LB or alternative scheme as may be approved.

Reason: To facilitate the early restoration of the listed building in the interests of its historic and architectural interest.

RESOLVED: That Application (B) be

GRANTED listed building consent in accordance with the submitted details, conditions, reasons and informatives set out in the report of the Director of Planning, Housing and Environmental Health.
