RESOLVED: That temporary planning permission be APPROVED, subject to:- (1) the amendment of Condition 1 by the substitution of the date 31 March 2013 for October 2011; (2) the amendment of Condition 2 to read: 2. The only Karts permitted to use the Kart circuit between the hour 22:00 to 23:00, between the days of Monday to Friday and in the period up to the expiry of this permission on 31 March 2013 shall be fitted with tyres of a compound as set out in letter dated 30 March 2011 or such alternative tyres as are to be made available in March 2012 (details of such tyres to be notified in writing to the Local Planning Authority prior to the first use of these tyres); and (3) the remaining conditions, reasons and informatives set out in the report of the Director of Planning, Transport and Leisure. Solar park at Land Off Bull Lane, Eccles, Aylesford. RESOLVED: That temporary planning permission be APPROVED, subject to:- (1) the following conditions: 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In pursuance of Section 91 of the Town and Country Planning Act 1990. 2. The use shall cease and the equipment be removed no later than 30 June 2036. Reason: To allow the impacts of the development to be reviewed at the end of the generating contract period. 3. All machinery, plant and materials associated with the development shall be confined to the application site boundary and not encroach into the Holborough to Burham Marshes SSSI. Reason: To ensure that this proposal does not result in negative impacts upon Holborough to Burham Marshes SSSI. 4. Off site scrub and woodland adjoining the boundaries of the North site and along the eastern and southern boundaries of the South site will be retained. Where lighting is required on site, this should be directional and orientated away from the adjoining habitats. Reason: In order to avoid harm to the maintenance of the population of bats. 5. Rubble piles and vegetated margins along the northern and eastern site boundaries will be retained and protected during construction. Reason: In order to avoid harm to the maintenance of the population of great crested newts. 6. No lighting shall be installed save with the express written approval of the Local Planning Authority. Reason: In the interest of the amenity of the area and nature conservation. 7. Within 1 month of the commencement of the development the applicant shall submit, for approval by the Local Planning Authority, details of: (a) an extension of the current habitat management plan for land north of the application site to cover this application site; and (b) a landscaping/boundary treatment scheme showing details of: i. Landscaping along the riverside frontage of the site ii. Security fencing iii. Peripheral planting including hedgerows The details in respect of both the habitat management plan (a) and the landscaping/boundary treatment scheme (b) shall include an implementation timetable which shall be adhered to thereafter. Reason: to ensure the longer term protection of any benefits to habitats/species that may arise from the exercise of this permission. 8. No materials shall be burnt on site. Reason: To protect the amenity of the wider area; and (2) the following Informative: 1. During the demolition/construction phase the hours of working (including deliveries) shall, where possible, be restricted to Monday to Friday 08.00 hours - 18.00 hours and Saturday 08.00 to 13.00 hours with no work on Sundays or Public Holidays.
