RESOLVED: That the Minutes of the meeting of Area 3 Planning Committee held on 28 May 2009 be approved as a correct record and signed by the Chairman.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning applications shown below.

AP3 09/044 (A) TM/09/00233/FL & (B) TM/09/00234/LB - 1 High Street, East Malling
(A) Conversion of existing residential accommodation on first and second floor to create two self-contained apartments with amenity space, parking and the erection of a terrace of three one bedroom dwellings with amenity space, parking, access and staff parking for existing restaurant at 1 High Street, East Malling.

(B) Listed Building Application: Conversion of existing residential accommodation on first and second floor to create two self-contained apartments with amenity space and parking at 1 High Street, East Malling.

RESOLVED: That application

(A) be GRANTED Planning Permission, subject to the following:

(1) Addition of condition:
11. Within two months of the date of this consent the dormer windows shall be constructed in conformity with the details indicated on drawing no. EM/08/017 Rev.A

Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality.

(2) Add informatives:

7. The applicant is advised to note the provisions of the Control of Pollution Act 1974 with regard to noise and disturbance from construction works. Works should be undertaken between the hours of 8am and 6.00pm Monday to Friday; 8am to 1pm Saturday, with no working on Sundays or Bank Holidays.
