Councillors R Brown, Mrs Oakley, Mrs Simpson, Thornewell and Mrs Woodger declared personal interests in Application TM/05/02443/OA in that they were members of East Malling and Larkfield Parish Council. They withdrew from the meeting during consideration of this item. The Vice-Chairman, Councillor Hickmott, chaired the meeting for this item.

Decisions were taken on the following applications subject to the prerequisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning and Transportation, or to the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the applications. Speakers are listed under the relevant planning applications shown below.

RESOLVED: That

Demolition of existing industrial buildings and erection of new residential development comprising 6 one bedroom flats, 21 two bedroom houses, 62 three bedroom houses, and 7 four bedroom houses; total 96 units; 186 garage/car port/surface parking spaces, new estate roads, open space and associated landscaping at New Road Business Estate, New Road, Ditton

RESOLVED: That the application be

APPROVED subject to

(1) the amendment of the recommendation to read:
'Grant Planning Permission as on the main agenda, subject to receipt of amended plans indicating the pathway link through the centre of the site and the layout of plots 85-87 inclusive; and also the following changes to the conditions and informatives in the report:'

(2) the deletion of condition 20 and the consequential renumbering of condition 21 as condition 20;

(3) the insertion of a new condition 21 as follows:
21. No later than one month following the commencement of the development hereby permitted, an affordable housing scheme shall be submitted to the Local Planning Authority for approval. For the purposes of this condition, such a scheme is one which:
a) Ensures the provision and implementation of 75% of the affordable housing as social rented and 25% as shared ownership accommodation in accordance with supplementary planning guidance. All the units should comply with Housing Corporation Scheme Development Standards and achieve an EcoHomes "Very Good rating"
b) Secures the involvement of a registered Social Landlord as defined by the Housing Act 1996 and on the Councils preferred RSL partners list; and
c) Ensures the affordable housing is produced at a cost within prevailing Housing Corporation guidance and cost indicator limits or future equivalent.
The development shall not be carried out other than in accordance with the approved scheme.
Reason: To ensure a satisfactory standard of development

(4) the deletion of condition 22 and consequential renumbering of condition 23 as condition 22;

(5) the amendment of condition 17 to read:
17. No development shall commence until an arrangement has been submitted to and approved in writing by the Local Planning Authority relating to the provision of a suitable contribution towards library and youth and community facilities in accordance with Kent County Council requirements for developer contributions and also for primary healthcare facilities in accordance with Maidstone Weald Primary Care Trust requirements for developer contributions. The development shall not be carried out other than in accordance with the approved arrangement.
Reason: To ensure a satisfactory standard of development.

(6) the addition of conditions:
23. No building shall be occupied until that part of the service road which provides access to it has been constructed in accordance with the approved plans. (H009)
Reason: To ensure the safe and free flow of traffic.
24. The access drive shall be constructed no steeper than 1 in 14.3 for the first 4.5 metres from the edge of the highway and no steeper than 1 in 8 on any other part. (H011)
Reason: To ensure the safe and free flow of traffic.
25. Any gateway to the access shall be set back 5.0 metres from the edge of the highway. (H013)
Reason: To enable vehicles to stand off the highway whilst any gates are being operated.
26. The garage(s) shown on the submitted plan shall be kept available at all times for the parking of private motor vehicles. (P009)
Reason: Development without provision of adequate accommodation for the parking or garaging of vehicles is likely to lead to hazardous on-street parking.
27. No building shall be occupied until the area shown on the submitted plan as a turning area has been provided, surfaced and drained. Thereafter it shall be kept available for such use and no permanent development, whether or not permitted by the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order), shall be carried out on the land so shown or in such a position as to preclude vehicular access to this reserved turning area. Reason: Development without provision of adequate turning facilities is likely to give rise to hazardous conditions in the public highway.
28. No development shall take place until elevational details and floorplans of the dwellings to be constructed at plots 8, 9, 10 and 11 as indicted on drawing no. 182 01H received 28.09.05 have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details.
Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality.
29. No development shall take place until details of the traffic calming in the vicinity of the junction of the access with New Road have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details.
Reason: In the interests of highway safety.

9. Due to the nature of the local road network around the site and close proximity of Ditton Junior and County Primary School the applicant is asked to ensure that the impact of construction activities on the surrounding area is minimised. In particular the developer is invited to apply for Prior Consent under the Control of Pollution Act 1974 (contact: Director of Health and Housing, Tonbridge and Malling Borough Council, Gibson Building, Gibson Drive, Kings Hill, West Malling, Kent, ME19 4LZ Tel: (01732) 844522) and to agree a timetable of construction traffic, avoiding peak school opening and closing times, with the Highways Manager, West Kent Division, Joynes House, New Road, Gravesend, Kent DA11 0AT. All parking of construction-related vehicles, including contractors' and operatives' personal transport, should be accommodated within the application site, rather than on surroundings roads.
