AP3 11/011 Declarations of interest.
Councillor D Davis declared a personal and prejudicial interest in application TM/10/01437/OA on the grounds that he was a near neighbour to the application site. He withdrew from the meeting during consideration of this item.

Councillor Keeley declared a personal and prejudicial interest in application TM/11/00241/FL on the grounds that he was a near neighbour to the application site. He withdrew from the meeting during consideration of this item.

Councillors Mrs Oakley and Simpson declared a personal and prejudicial interest in applications TM/11/00058/FL and TM/11/00059/LB on the grounds that the applicant's wife was a family friend. They withdrew from the meeting during consideration of these items.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning applications shown below.
AP3 11/014 TM/10/01437/OA - 125 Rochester Road, Burham
Outline Application: Demolition of existing public house and redevelopment of site with 11 no.3 bedroom houses with associated access and parking facilities at
125 Rochester Road, Burham.

RESOLVED: That the application be

REFUSED as the proposed development would be an over intensive development of the site, which has an inherently open character and lies at the point of transition between the terraced frontage housing to the north west and the lower density housing to the south east. This would be to the detriment of the built environment, amenity and character of the existing settlement and is therefore contrary to Policy CP24 of the Tonbridge and Malling Local Development Framework Core Strategy 2007.

Two storey side, single storey rear extensions plus porch and garage to front at 27 Godden Road, Snodland.

RESOLVED: That the application be

REFUSED as the proposed extension, by virtue of the prominent siting in the existing street scene of the forward garage extension, would be detrimental to the open aspect of this part of the street scene in Godden Road and is therefore contrary to Policy CP24 of the Tonbridge and Malling Local Development Framework Core Strategy 2007.Reason:

Variation of planning condition 3 of TM/04/00743/FL and planning condition 2 of TM/05/01353/FL to extend Saturday opening hours until 11.30pm. Variation of planning condition 4 of TM/05/01353/FL to allow for the use of the tea garden and variation of planning condition 1 of TM/05/01355/RD to provide outside seating for 20 people at 2 - 4 Forstal Road, Aylesford.

RESOLVED: That the application be

APPROVED, subject to: -

(1) the conditions as set out in the report of the Director of Planning, Transport and Leisure;

(2) the addition of conditions:

7. Any amplified music or speech played within the premises shall be restricted to such a level to be barely audible outside the nearest noise sensitive premises.

Reason: In the interests of the aural amenity of neighbouring residential dwellings.

8. Within two months of the date of this permission details of a scheme for the collection and disposal of cigarette waste and related rubbish at the front of the premises shall be submitted to for approval in writing by the Local Planning Authority. This scheme shall be fully implemented within one week of the details being approved and shall be thereafter be so retained.

Reason: To prevent the existence and spread of rubbish on the High Street.

(3) the addition of an informative:

Adequate signage shall be provided by the applicant to remind the clientele that the premises is located within a residential area and due consideration should be shown to the occupiers of the neighbouring dwellings particularly when leaving the premises.
