DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
AP2 08/062 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.
AP2 08/063 TM/08/00467/FL - The Paddock, Basted Lane, Crouch
Change of use of building from residential annexe to residential dwelling (C3)at

RESOLVED: That the application be

REFUSED on the following grounds:

(1)The proposal is detrimental to highway safety as it is likely to lead to an intensification of use of the existing access which would create additional hazards to traffic and pedestrians because of its inadequate and limited width and sub standard forward vision at the junction with Basted Lane. The proposal is thereby contrary to Policy QL1 of the Kent and Medway Structure Plan 2006 and Policy CP13 of the Tonbridge and Malling Borough Core Strategy 2007.

RESOLVED: That the application be

APPROVED, subject to

(1) Addition of conditions:

16. No development shall take place until details and samples of all materials to be used externally have been submitted to and approved by the Local Planning Authority, and the development shall be carried out in accordance with the approved details and shall be retained as approved thereafter.

Reason: To ensure that the development does not harm the character and appearance of the existing building or the visual amenity of the locality.

17. No development shall take place until details of measures to be installed at the junction of the site access with Church Lane to improve vehicular and pedestrian safety have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details before the building is occupied pursuant to this planning permission and retained thereafter.

Reason: In the interests of highway safety.

(2) Amendment to Condition:

9. No development shall take place until details of external lighting and/or security lighting (including the hours of use) have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details.

Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality.

(3) Additional resolution:
That the Highway Authority be requested to review the speed limit along this section of Church Lane at the earliest opportunity.

REFUSED on the following grounds:

(1) The proposed walls, piers, railings and gates to the frontage with The Street are inappropriate in a rural location, out-of-character with the locality and harmful to the character and appearance of the Conservation Area. The proposal is therefore contrary to PPG15 (Planning And The Historic Environment), Policies QL1 and QL6 of the Kent and Medway Structure Plan 2006 and Policies CP1 and CP24 of the Tonbridge and Malling Borough Core Strategy 2007.
