DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
AP3 08/045 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning applications shown below.
AP3 08/046 TM/08/01066/FL - Karting Centre, Buckmore Park, Maidstone Road, Chatham
Use of kart circuit between hours of 0800-2300 Monday to Friday between 1st March and 31st October (variation of condition 2 of TM/97/01734/FL and condition 1 of TM/99/02100/FL) at Karting Centre, Buckmore Park, Maidstone Road, Chatham.

RESOLVED: That the application for Section 73 Approval be

(1) The amendment of the recommendation to read:-
'Grant Section 73 Approval in accordance with the following submitted details: Certificate B dated 28.03.2008, Letter dated 28.03.2008, Details BACKGROUND dated 28.03.2008, Location Plan dated 28.03.2008, Noise Assessment dated 28.03.2008, Letter dated 04.07.2008, Letter dated 29.07.2008, Technical Note dated 07.07.2008, Letter dated 01.08.2008 subject to the following conditions:'

(2) The amendment of conditions 2 and 3 to read:-
2. There shall be no more than 18 karts on the kart circuit at any one time between the hours of 22:00 and 23:00, between the days of Monday to Friday and between the dates of 1 March to 31 October.
Reason: In the interests of the aural amenity of the nearby residential properties.
3. The only karts permitted to use the kart circuit between the hour 22:00 to 23:00, between the days of Monday to Friday and between the dates of 1 March to 31 October shall be four stroke karts fitted with Luna Exhaust System silencers as detailed in submitted letter dated 29 July 2008 and attached Technical Note.
Reason: In the interests of the aural amenity of the nearby residential properties.

(3) the addition of Informatives
2. The applicant is advised that a separate planning permission will be required should you wish to extend the use of the tannoys during the extra hour.
3. In order that an appropriate assessment may be made at the end of this temporary planning permission, the applicant is asked to collaborate with the Borough Council's Director of Health and Housing and Medway Council in the monitoring of the noise levels during the extra hour.

Reserved matters application for the construction of Greenway Link between Peters Village and Wouldham including provision of segregated footway/cycleway submitted pursuant to conditions 1 and 27 of planning consent TM/05/00989/OAEA (Formation of development platforms and creation of new community including residential development, mixed-use village centre (including A1; A3 and B1 use), community facilities and primary school and associated highways works) at former Peters Pit and Peters Works Site, Hall Road, Wouldham.

RESOLVED: That the application be

APPROVED subject to the addition of Informatives

2. The applicant is advised to consider incorporating the hedgerow practice of laying hedges as part of the landscape management scheme for the maintenance of the new hedgerows.
3. The applicant is advised that the sub base of the bridleway should also be ragstone.
4. The applicant is advised to monitor and review the operation of the traffic signals and shuttle system to ensure that any queuing outside 111-113 Hall Road cottages is kept to a minimum.
