RESOLVED: That (1) delegated authority be given to the Director of Planning and Transportation to GRANT PLANNING PERMISSION, subject to (a) the applicant agreeing a reduction in the slab level height of the proposed dwelling by 1 metre; (b) further investigations into whether or not parking facilities should be provided for neighbouring dwellings and also into ways to reduce the impact of parking facilities on Brickfield Cottages; and (c) the issue of hedge/boundary treatment along the boundary with Brickfield Cottages being investigated to see whether a reduction in height can be achieved. Acceptance of these being delegated to the Director of Planning and Transportation. The Notice not to take effect not less than 28 days from the date of service, subject to: The concurrence of the Chief Solicitor, he being authorised to amend the wording of the Enforcement Notice as may be necessary; and In the event of an appeal against the Notice, the Secretary of State and the appellants to be advised that the Local Planning Authority is not prepared to grant planning permission for the development the subject of the Enforcement Notice. (3) In the event of the Enforcement Notice not being complied with and subject to satisfactory evidence, the Chief Solicitor BE AUTHORISED to commence any proceedings which may be necessary under Section 179 of the Town and Country Planning Act 1990 (as amended) to secure compliance with the Enforcement Notice.
