AP2 07/001 Declarations of interest.
Councillor Balfour declared a personal and prejudicial interest in application TM/06/03588/FL, as a nearby resident, and application TM/06/02828/FL as a member of his family was an adjoining landowner. He withdrew from the meeting during consideration of these items.

Councillor Evans (Chairman) declared a personal and prejudicial interest in application TM/06/03541/OA as the applicant was known to him and withdrew from the meeting during consideration of this item. The Vice Chairman, Councillor Rogers chaired the meeting for this application.

2. The Local Planning Authority is not satisfied that an access that would be adequate in highway safety terms could be provided in such a manner as would preserve the amenity and character of the street scene and, therefore, the proposal would be contrary to policy P4/11 of the Tonbridge and Malling Borough Local Plan 1998.
3. The proposal would, by virtue of the first floor west (front)facing windows, result in an unacceptable level of overlooking which would be contrary to policy annex PA4/12 of the Tonbridge and Malling Borough Local Plan 1998.

RESOLVED: That the application be

REFUSED on the grounds that the height and size and bulk of the proposed building would be too great for this site and would be likely to give rise to an unacceptably cramped and overdeveloped appearance to the site and give rise to harm to the openness of the MGB. Accordingly, the proposal is considered to be contrary to the provisions of polices P6/18 and P2/16 of the TMBLP and SS2 of the KMSP.

Members expressed concern about hours of working (24/7 operation for the facility was not considered acceptable), the layout of the loading bays, the need for a condition to secure the retention of the voids for flooding reasons, and construction noise. If the opportunity arises (either through an appeal or the submission of an alternative scheme) officers were asked to give further consideration to these issues.
