AP3 09/034 Declarations of interest.
Councillor Balcombe declared a personal and prejudicial interest in the item relating to Tree Preservation Order No 2 2009 on the grounds that he was a close neighbour to the property at which the Order had been made. He withdrew from the meeting during consideration of this item.

Councillor Mrs Simpson declared a personal and prejudicial interest in application TM/08/03256/CR4D in that she was the Chairman of the Board of Governors at St James County Primary and Nursery School, East Malling and she withdrew from the meeting during consideration of this item.

Councillor Mrs Woodger declared a personal and prejudicial interest in application TM/08/03256/CR4D in that she was a member of the Planning Committee of East Malling and Larkfield Parish Council and had been present at the meeting where this application had been considered by the Parish Council. She withdrew from the meeting during consideration of this item.

AP3 09/036 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning applications shown below.
AP3 09/037 TM/08/03256/CR4D - Former Mill Stream School, Mill Street, East Malling
Proposed redevelopment of the former Mill Stream Junior School to provide 23 new residential dwellings comprising a mix of 1, 2, 3 and 4 bed units together with associated garaging and parking at former Mill Stream School, Mill Street, East Malling

RESOLVED: That the application be

APPROVED subject to

(1) the applicant providing a unilateral undertaking as set out in the report and to referral to the Secretary of State (GOSE) as a Departure from the Development Plan; and

(2) the addition of condition
18. Development shall not be begun until full details of the table junction between the proposed service road, Mill Street and Cottenham Close have been submitted to and approved by the Local Planning Authority; and no building shall be occupied until that junction has been constructed in accordance with the approved details.
Reason: To ensure the safe and free flow of traffic.

In addition Members requested that a letter be sent to Kent County Council (copied to the applicant) urging them to revisit the access to the PFI scheme to provide a single point of access for both developments which could be achieved with some co-operation of East Malling and Larkfield Parish Council which owns the adjoining site.

The report of the Central Services Director set out details of an objection received from the owner of 429 London Road, Ditton in respect of Tree Preservation Order No. 2 2009.

RESOLVED: That Tree Preservation Order No 2 2009 be confirmed as served.
