Conversion of 2 agricultural buildings to create an additional 10 liveries plus hydrotherapy spa area + 2 associated stables (part retrospective)at Tower Farm, 231 Offham Road, West Malling.

RESOLVED: That the application be

APPROVED subject to:

(1) Addition of condition
7. Within one month of this decision, details of necessary alterations to the access at the junction with Offham Road to allow for a width of 5.5m for a length of 12m, shall be submitted for the approval of the Local Planning Authority; and the junction shall be amended in accordance with the approved details within three months of that approval. Reason: To ensure the safe and free flow of traffic and pedestrian safety on a Public Right of Way.

(2) Amend condition 1 to read
1. The number of horses accommodated on the land holding of Tower Farm, Offham Road shall not exceed 16 including those of the owner.
Reason: A more intensive use of the site could harm significantly the amenities of the locality and the free flow of traffic on local highways.

AP2 06/169 TM/06/02342/CR3 - The Poplars, London Road, Wrotham
Redevelopment to provide integrated highway depot comprising offices, garaging, salt barn and storage areas with associated car parking and landscaping at The Poplars, London Road, Wrotham.

RESOLVED: That Kent County Council BE INFORMED that the Tonbridge and Malling Borough Council is deeply dissatisfied with this application; both in its substance and the way it has emerged. The Borough Council is unconvinced by the responses to the queries raised in its letter of 22 September 2006. The Council also considers that the points raised in support of the latest revision to the application are not well articulated, meaningful or persuasive.

The Borough Council reiterates its comments that the following matters must be fully addressed:

#HGVs should not be permitted to make a right turn exit from the site in the interests of highway safety and the free flow of traffic.
#Changes should be made to the design of the upper part of the south-west elevation of the office block, in the interests of privacy of neighbouring residential properties yet retaining an adequate internal environment to the office and to the salt barn's height and design such that it be more traditional in appearance and therefore more in keeping with the locality.
#Appropriately worded conditions should be imposed to secure compliance with the Travel Plan and with noise, air quality and light pollution mitigation as detailed in the application's supporting documents. The Travel Plan should be the subject of early consultation with TMBC and Wrotham Parish Council (WPC).
#All external materials should be subject of early consultation with TMBC and should be as subdued as possible to minimise visual prominence in longer distance views within the Area of Outstanding Natural Beauty.
#All possible steps should be taken to avoid the risk of contamination of local water courses by salt, road scalpings, surfacing and other materials - the County Council is asked to review this matter further with the EA.

In addition the Borough Council considers that the following further issue requires additional consideration:

#In accordance with PPS23 (Planning and Pollution Control), KCC must satisfy itself that the potential for contamination and any risks are properly assessed and the development incorporates any necessary remediation and subsequent management measures to deal with unacceptable risks.
#Much of the application gives the impression that the details required much more examination.

The Borough Council considers that the comments of Wrotham Parish Council (including the recent press release and including in particular consideration of the adequacy of the width of the access road should be 6m in accordance with Kent Design Guide 2003 and the need to provide adequate visitor parking at the site should be compared and contrasted with KCC's own design guidelines). Platt Parish Council, 'Keep Boroughs Green' group and Borough Green Traffic Action Group consultation documents as copied to Tonbridge and Malling Council merit very careful consideration and the County Council is urged to enter into a direct dialogue with those groups and local residents to understand and address their concerns.

RESOLVED: That the application be

REFUSED for the following reasons:

(1) On the grounds that the proposal would, as a result of its design, bulk, height and orientation, have a detrimental impact upon the character of the village and particularly in terms of the views of the village from the wider countryside.
