1. The proposed dwelling due to its location remote from local service centres and with limited scope for walking, cycling or use of public transport will increase the need to travel by private car and hence represents an unsustainable pattern of development, contrary to PPS7 (Sustainable Development in Rural Areas) and Policy SP1 and Policy HP6 (as proposed to be modified)of the Kent and Medway Structure Plan (Deposit) 2003.

RESOLVED: That the application be

APPROVED subject to
(1) the applicants entering into a S106 agreement regarding the payment of a contribution towards the provision of youth and community facilities in the vicinity of the site;
(2) the amendment of Condition 4 to read:
4. 'No development shall take place until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping and boundary treatment. The scheme shall include full details of the construction, design and landscape screening of the front boundary wall together with appropriate arrangements for the maintenance in perpetuity of that wall and its screening vegetation. All planting, seeding and turfing comprised in the approved scheme of landscaping shall be implemented during the first planting season following occupation of the buildings or the completion of the development,whichever is the earlier. Any trees or shrubs removed, dying, being seriously damaged or diseased within 10 years of planting shall be replaced in the next planting season with trees or shrubs of similar size and species, unless the Authority gives written consent to any variation.'
Reason: Pursuant to Section 197 of the Town and Country Planning Act 1990 and to protect and enhance the appearance and character of the site and locality.
(3) The addition of conditions:
14. No development shall take place until details of external lighting have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details.
Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality;
15. No development shall begin until an arrangement has been submitted to and approved in writing by the Local Planning Authority relating to the provision of secondary school places in accordance with the Kent County Council requirement for development contribution towards education facilities (which applies a pupil product ratio of 0.15 secondary pupils per dwelling multiplied by the Kent County Council adopted school extension build costs). The development shall not be carried out other than in accordance with the approved scheme.
Reason: In order to secure contributions to the education system pursuant to policy P8/1 of the Tonbridge & Malling Borough Local Plan 1998;
16. The premises shall not be occupied until the existing eastern vehicular access to Maidstone Road has been closed permanently.
Reason: To ensure the safe and free flow of traffic;
17. No development shall be commenced until full details of a scheme of acoustic protection of habitable rooms having windows that will be exposed to a level of road traffic noise in Noise Exposure Categories B, C or D as set out in Policy P3/17 of the Tonbridge and Malling Borough Local Plan have been submitted to and approved in writing by the Local Planning Authority. The scheme of acoustic protection shall be sufficient to secure internal noise levels no greater
than 30 LAeq dB in bedrooms and 40 LAeq dB in living rooms with windows closed. Additionally, where the internal noise levels will exceed 40 LAeq dB in bedrooms or 48 LAeq dB in living rooms with windows open the scheme of acoustic protection shall incorporate appropriate acoustically screened mechanical ventilation. Mechanical ventilation shall also be provided to bedrooms having openings into facades that will be exposed to a level of road traffic noise in excess of 78 LAmax (Slow) time weighting. The approved scheme shall be implemented prior to the first occupation of the dwelling to which it relates and shall be retained at all times thereafter. (N016)
Reason: To safeguard the aural amenity of the occupiers of the dwelling(s) hereby approved;
18. No development shall take place until details of a scheme aimed at safeguarding the amenities of residents of The Ferns against noise and disturbance arising from the use of the car park have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details. The details shall include the provision of suitable acoustic boundary fencing and landscaping. The approved scheme shall be implemented before the car park area is first brought into use in connection with the development hereby approved, and shall be retained at all times hereafter.
Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality;
