AP 07/050 Declarations of interest.
Councillor Balfour declared a personal and prejudicial interest in application TM/01/02768/FL, as a member of his family owned the land giving access to the site. He withdrew from the meeting during consideration of this application.

Councillor Mrs Kemp declared a personal and prejudicial interest in applications TM/03/03918FL and TM/06/04015/FL in that the agent acted for her in similar circumstances. She withdrew from the meeting during consideration of this application.

RESOLVED: That the Minutes for the meeting of Area 2 Planning Committee held on Wednesday 18 April 2007 be approved as a correct record and signed by the Chairman, subject to an amendment to the Declarations of Interest to read 'Councillor Balfour declared a personal and prejudicial interest in application TM/06/03491/FL, as a member of his family was an adjoining landowner'.
AP 07/052 Chairman's Announcements
The Chairman welcomed new Members to the Committee and expressed his gratitude to the outgoing Chairman, Councillor Evans, for his advice and encouragement. The Leader acknowledged the active participation of Councillor Evans in chairing the planning committee recognising his attention to detail and conscientiousness approach.

Councillor Evans thanked the Members for their kind remarks and congratulated the new Chairman, Councillor Rogers, on his appointment wishing him good luck and acknowledged his support as Vice Chairman.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.

5 bedroom house with integral garage to replace existing bungalow at Orchard Cottage, Comp Lane, Platt.

RESOLVED: That the application be

APPROVED subject to

(1) The additional of a condition:
9. No development shall take until details of the slab levels of all buildings to be constructed, relative to a fixed and identifiable datum point, have been submitted to and approved by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
Reason: In the interests of visual and residential amenity.

(2)The addition of an informative:
5. The applicant is advised that if any works are proposed to prune or remove a tree located within a Conservation Area, the applicant must notify the Local Planning Authority of their intent 6 weeks prior to commencement of the proposed works. APPROVED subject to:

(1) The applicant entering into a Section 106 agreement as outlined in the report of Director of Planning, Transportation and Leisure.

(2) The amendment of Condition 5 to read:
5. The site shall only open to members of the public during the hours of 10.00am to 20.00pm or dusk whichever is the earlier.
Reason: In the interests of the amenities of the Metropolitan Green Belt and highway safety.

RESOLVED: That the application be

REFUSED for the following reasons:

(1) The proposal would result in the loss of a housing unit to commercial use which is incompatible with the characteristics of the site, and its surroundings and the highways serving it. The proposal is, therefore, contrary to Policy P5/3 and P6/14 of the Tonbridge and Malling Borough Local Plan.

(2) The change in scale and natural of traffic movements entering and exiting the site would introduce perceived additional hazards to highway safety.

Erection of a detached barn style house and ancillary garage at land adjacent to Tudor Barn, Long Mill Lane, Platt.

RESOLVED: That the application be

REFUSED for the following reasons:

(1) The proposed dwelling, by reason of its size, bulk, design, appearance and materials will harm the appearance of the Conservation Area which includes a number of listed buildings. The proposal is thereby contrary to Policies QL1 and QL6 of the Kent and Medway Structure Plan 2006 and policies P4/4 and P4/11 of the Tonbridge and Malling Borough Local Plan 1998.

(2) The proposed dwelling, by reason of its siting, size, bulk, design, appearance and materials will be detrimental to the visual amenities of the adjoining Green Belt, Special Landscape Area and Area of Local Landscape Importance. The proposal is thereby contrary to Policy QL1 of the Kent and Medway Structure Plan 2006 and policies P2/16, P3/6, P3/7 and P4/11 of the Tonbridge and Malling Borough Local Plan 1998.

RESOLVED: That the application be

APPROVED, subject to:

(1) Amended recommendation:
Amendment to first bullet point to read 'The submission of a satisfactory unilateral undertaking submitted under S106 of the Town and Country Planning Act'.

(2) The addition of condition:
8. The existing hedge located along the sites frontage with Church Road and track providing vehicular access to the dwelling shall be retained at all times and shall not be lopped, topped or removed without the prior written consent of the LPA.
Reason: In the interests of amenity.

(3) The addition of informative:
2. The Public Right of Way adjacent to the site should be kept free of obstructions at all times. No works should take place within the Public Right of Way without the prior consent of the Highway Authority.
