Indemnities for Members and Officers |
Consideration was given to a joint report by the Director of Finance and Chief Solicitor concerning the Local Authorities (Indemnities for Members and Officers) Order 2004, which enabled local authorities to grant indemnities to Members and officers who might incur personal civil and criminal liability as a result of their actions, both within the authority and as a result of their actions carried out on behalf of an outside body. The report detailed the circumstances in which the Council was allowed to give an indemnity and explained that the Council's insurance cover would continue to be provided for activities flowing from the Council's business. As a result the Council offered indemnity on the proviso that the indemnity could be supported by appropriate insurance cover arrangements. RECOMMENDED: That Members endorse the Council's stance to offer indemnities to Members and officers only in those circumstances in which the risk is underwritten by insurance arrangements. *Referred to Council |
