Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

3. The extension shall not be occupied until two parking spaces have been made available within the curtilage of the property. Thereafter these spaces shall be kept available for such use and no permanent development, whether or not permitted by the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order), shall be carried out in such a position as to preclude their availability for vehicle parking.

Reason: Development without provision of adequate accommodation for the parking of vehicles is likely to lead to hazardous on-street parking.

1. The applicant is advised to consider softening the side elevation facing towards No. 4 Roman Close, either through the use of appropriate surfacing materials or soft landscaping.

(A) Reserved matters application for the construction of new and improvements to existing highways between Peters Village and the junction of Rochester Road and Pilgrims Way submitted pursuant to conditions 1 and 26 of planning consent TM/05/00989/OAEA (Formation of development platforms and creation of new community including residential development, mixed-use village centre (including A1; A3 and B1 use), community facilities and primary school and associated highways works)
at the former Peters Pit and Peters Works Site, Hall Road Wouldham.

(B) Additional infrastructure and associated landscaping as part of the new construction and improvements to existing rights of way between Peters Village and the junction of Rochester Road/Pilgrims Way at the former Peters Pit and Peters Works Site, Hall Road, Wouldham.

RESOLVED: That

(A) The Director of Planning, Transport and Leisure be delegated to APPROVE Reserved Matters, subject to:

(1) the submission of satisfactory replacement wooden chicanes on the footpath crossings at MR29 and MR464 and equestrian hurdles along bridleway MR10.

(2) subject to the applicant changing the bridleway surface from granite fines to ragstone fines.

(3) Additional informative:
1. With regard to the diversion of footpaths and bridleways, the applicant must contact Kent County Council Strategic Planning, West Kent Public Rights of Way Office, 8 Abbey Wood Road, Kings Hill, West Malling, Kent MR19 4YT. The applicant is also requested to contact the Ramblers Association and the British Horse Society.

Alleged Unauthorised Development at 222 - 224 Bull Lane, Eccles, Aylesford.

RESOLVED: That

(1) An Enforcement Notice be issued as set out below and copies be served on all interested parties.

The Notice to take effect not less than 28 days from the date of service, subject to:

• The concurrence of the Chief Solicitor, he being authorised to amend the wording of the Enforcement Notice as may be necessary.
• In the event of an appeal against the Notice the Secretary of State and the appellant to be advised that the Local Planning Authority is not prepared to grant planning permission for the development the subject of the Enforcement Notice.

Breach Of Planning Control Alleged

Without planning permission the installation of three air conditioning condenser units and associated fixing brackets, pipes and cables at first floor level on the exterior of the north-western or rear elevation of the building.

Reasons For Issuing The Notice

It appears to the Local Planning Authority that the above breach of planning control has occurred within the last four years. The installation of the air conditioning units was completed less than four years ago. The unauthorised development because of its poor quality design and the number, size, scale and location of the units results in a prominent and incongruous feature that detracts from the appearance of the building and the residential area and is detrimental to the residential and visual amenity of the locality. Because of the very limited spatial separation between the condenser units and windows to habitable rooms on the adjacent dwellinghouse, it is considered that noise from their operation is likely to cause significant and unacceptable detriment to aural and residential amenity of nearby residents. The unauthorised development is therefore contrary to Policies CP1 and CP24 of the Tonbridge and Malling Core Strategy 2007. The Local Planning Authority does not consider that planning permission should be given because planning conditions could not overcome the policy objections to the development. The service of the Enforcement Notice is required to ensure the proper planning of the area and to remedy a serious injury to the amenity of the residential area.

Requirement

Dismantle and remove from the exterior of the rear, north-western wall of the building, all air conditioning condenser units and all associated fixing brackets, pipes, cables, fixtures and fittings and fill and make good all holes in the wall.

Period For Compliance

28 days from the date that the Notice takes effect.

(2) Further Proceedings

In the event of the Enforcement Notice not being complied with and subject to satisfactory evidence, the Chief Solicitor be authorised to commence any proceedings which may be necessary under Section 179 of the Town and Country Planning Act 1990 (as amended) to secure compliance with the Enforcement Notice.
