RESOLVED: That the application be

REFUSED for the following reason:
(1) The proposed dwelling by reason of its position and height, and its relationship to the existing dwellings at 1 and 2 Crow Hill, would have an overbearing impact upon those properties, to the detriment of their amenity. The detailed design and appearance of the proposed dwelling would also be poorly related to and out of character with the adjacent residential properties. For both these reasons the proposal is considered to be contrary to policy QL1 of the Kent and Medway Structure Plan 2006 and policy P4/11 of the Tonbridge and Malling Borough Local Plan 1998.

RESOLVED: That an enforcement notice be ISSUED as set out in the report and copies BE SERVED on all interested parties.

In the event of the enforcement notice not being complied with and subject to satisfactory evidence, the Chief Solicitor BE AUTHORISED to commence any proceedings which may be necessary under Section 179 of the Town and Country Planning Act 1990 (as amended) to secure compliance with the enforcement notice.
