RESOLVED: That the Minutes of the meeting of the Area 3 Planning Committee held on 4 March 2010 be approved as a correct record and signed by the Chairman.
DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
AP3 10/022 Development Control
Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning applications shown below.
AP3 10/023 TM/10/00846/CR3 - The Malling School, Beech Road, East Malling
Erection of 1.8m high steel fencing, finished in dark green, with vehicular and pedestrian access gates (TM/10/TEMP/0009) at The Malling School, Beech Road, East Malling.

RESOLVED: That the Kent County Council be advised that

(A) the Borough Council raises objection to the proposed fencing unless
1. The County Council is able to satisfy itself that the proposal would not decrease public safety through the loss of informal pedestrian routes and that there are alternative and safe walking routes bearing in mind the lack of footways along Clare Lane.
2. The County Council is satisfied that the proposal would not result in any anti-social behaviour being forced closer to the residential properties in Clare Wood Drive.
3. Additional planting is to be carried out on each side of both lengths of proposed fence (including the permitted development fence). The planting should be used to soften the impact of the fencing and also to reduce the impact of the interface between the fence and the lake margin.
4. A condition is attached to any consent requiring the fence to be painted a dark green colour.

(B) the Borough Council requests that a County Members' site inspection be carried out prior to the application being determined so that Members of the County Planning Committee can familiarise themselves with the special nature of the landscape.

(C) The Malling School be invited to enter into discussions regarding the future maintenance and use of the northern piece of land and the potential for transferring it to the Parish Council.
