Councillors Mrs Brown, Dalton, Mrs Grant, D Smith and Stone declared personal and prejudicial interests in Planning Application TM/07/03201/FL as 'close associates' of the applicant, Councillor D Keeley. As they had not received dispensations from the Standards Committee to allow them to participate in consideration of this item they withdrew from the meeting. Councillor Keeley declared a personal and prejudicial interest in application TM/07/03201 as the applicant and withdrew from the meeting during consideration of this item.

Details of footpath, cycleway and bridleway strategy submitted pursuant to condition 26 of planning permission TM/05/00989/OAEA: Formation of development platforms and creation of new community including residential development, mixed-use village centre (including A1; A3 and B1 use), community facilities and primary school and associated highways works at former Peters Pit And Peters Works Site, Hall Road, Wouldham

RESOLVED: That the application be

APPROVED subject to the addition of Informatives

2. The applicant is advised that a separate planning permission will be required for the creation of a segregated footpath and cycleway from Burham Old Church, along Court Road, up to Bell Lane and MR454.

3. The applicant is advised that the Council considers that, without prejudice to any detailed proposal that may come forward, a segregated footpath and cycleway along Court Road is the preferred option for cyclists, rather than the provision of this facility within the carriageway.

4. The applicant is asked to enter into discussions with Kent County Council, the local Parish Councils and local residents to explore options for a scheme that would secure the closure of Scarborough Lane and Margetts Lane as public roads, whilst still maintaining an appropriate level of access for frontagers and others.

(A) Conservation Area Consent: Demolition of existing building
(B) Demolition of existing building and erection of three houses and two maisonettes with parking at Church of St Thomas of Canterbury, 28 Holborough Road, Snodland

RESOLVED: That

Application (A) be

REFUSED for the following reason:
1. The demolition of the building, located within a designated Conservation Area, would be premature in the absence of any approved proposal to replace it and would damage the character and appearance of the Area, which it is desired to preserve and enhance. (CR03)

and application (B) be

REFUSED for the following reasons:
1. The design, bulk, scale and height of the proposed development is considered to be out of keeping and would result in an overintensive form of development for this site within the Snodland Conservation Area. The proposed development will harm the visual amenity of the locality as well as neither preserving nor enhancing the character of the Conservation Area. As such the proposal is contrary to policies CP24 of the Tonbridge and Malling Borough Core Strategy 2007 and QL1 and QL6 of the Kent and Medway Structure Plan 2006, and Planning Policy Guidance Note No.15: Historic Environment.
2. The proposed garaging for the proposed development is considered to be inadequate, particularly in terms of the size of the garage spaces and the provision of garage doors immediately adjacent to the back edge of the public footpath. As such the proposal would be likely to result in hazardous highway conditions and would be contrary to policy TP19 of the Kent and Medway Structure Plan 2006.
