Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or in the variations indicated below. Supplementary reports were tabled at the meeting.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.

Ground floor extension to form enlarged dining and hall amendments to existing car parking and front boundary at Stoned Lodge, The Street, Ryarsh.

RESOLVED: That delegated authority be given to the Director of Planning, Transport and Leisure to grant planning permission, subject to the submission of formal amended plans to change the flank wall to a single pillar and a 14 day consultation period with neighbouring residential properties that raises no additional or new issues.

RESOLVED: That planning permission be REFUSED for the following reason:

(1) The proposed two storey side extension to the western flank, the relocation and rebuilding of the front boundary wall and the introduction of vehicular gates will have a cumulative overall detrimental impact on the character of the area. This is harmful to the character and appearance of Conservation Area and to the setting of Listed Buildings and thereby contrary to paragraphs 17, 60, 65, 129, 131, 132 of the National Planning Policy Framework 2012 and policies CP1, CP24 of the Tonbridge and Malling Borough Core Strategy 2007 and policy SQ1 of the Tonbridge and Malling Managing Development and the Environment Development Plan Document 2010.

RESOLVED: That listed building consent be REFUSED for the following reason:

(1) The proposed two storey side extension to the western flank, the relocation and rebuilding of the front boundary wall and the introduction of vehicular gates will have an overall detrimental impact on the character of the area. This is harmful to the setting of Listed Buildings and thereby contrary to Section 16 of the Planning (Listed Buildings and Conservation Areas) Act 1990 and paragraphs 17, 60, 65, 129, 131, 132 of the National Planning Policy Framework 2012.
AP2 12/081 TM/12/02594/FL - Marvillion Court, The Freehold, East Peckham
Proposed redevelopment of existing sheltered housing site for 4 flats, 12 houses and associated works at Marvillion Court, The Freehold, East Peckham.

RESOLVED: That the application be

APPROVED in accordance with the submitted details, conditions, reasons and informatives set out in the report of the Director of Planning, Transport and Leisure, subject to the following:

(1) Amendment to Condition:

14. No development shall take place until details of surface water drainage have been submitted to and approved by the Local Planning Authority. The submitted scheme shall incorporate Sustainable Drainage System (SUDS) principles, including the provision of permeable surfaces so far as practicable. The work shall be carried out in strict accordance with the approved details.

Reason: In order to prevent pollution of ground water in accordance with Policy CC3 of the Tonbridge and Malling Managing Development and the Environment Development Plan Document 2010 and Paragraph 120 of the National Planning Policy Framework 2012.

AP2 12/082 TM/12/01290/FL - The London Golf Club, South Ash Manor, South Ash Road, Ash
Diverted access road to permitted hotel on land to the west of South Ash Road. The relocation of the existing driving range on land to the east of South Ash Road. A European Tour Performance Institute (ETPI) driving range building. A 9 hole golf course created utilising the cut from the hotel development. Chipping area and putting green. An underpass under South Ash Road. Areas of hard standing including car parking and access road. Diverted public rights of way. Associated reservoir and landscaping at the London Golf Club, South Ash Manor, South Ash Road, Ash, Sevenoaks.

RESOLVED: That the application be

APPROVED in principle in accordance with the submitted details, conditions, reasons and informatives set out in the main and supplementary reports and that authority be delegated to the Director of Planning, Transport and Leisure to grant planning permission subject to the following:

(a) Receipt of amended plans to include additional hedgerows and landscaping along the southern boundary, additional suitable plantings along the eastern boundary to assist in shielding the Bridleway from stray golf balls and a review of the range of species in favour of those of local provenance;

(b) A further period of consultation; and

(c) Additional conditions and informative, set out below:

18. No development shall take place until details of a sustainable water management plan have been submitted to and approved by the Local Planning Authority, and the work shall be carried out in strict accordance with those details.

Reason: In the interests of water conservation in accordance with paragraph 94 of the National Planning Policy Frame 2012.

19. No additional soil or waste materials shall be brought onto the application site for the purposes of reconfiguring the land on the application site other than those arising directly from approved operations within the site of the London Golf Club as a whole, and the minimum necessary certified clean topsoil or bunker sand.

Reason: In compliance with the Sustainability Statement hereby approved and in the interests of minimising the transportation impacts of the 2 schemes in accordance with Policies CP1 of the Tonbridge and Malling Borough Core Strategy, Policy SQ8 of the Tonbridge and Malling Borough Managing Development and the Environment Development Plan Document and Paragraphs 30 and 32 of the National Planning Policy Framework (2012).

20. There shall be no primary vehicular access to the driving range or 9-hole golf course hereby approved from Ash Lane or South Ash Road and there shall only be access for emergency or general maintenance vehicles unless otherwise agreed in writing by the Local Planning Authority.

Reason: In the interests of highway safety in accordance with Policy SQ8 of the Tonbridge and Malling Managing Development and the Environment Development Plan Document 2010 and Paragraphs 30 and 32 of the National Planning Policy Framework (2012).

(2) Additional informative:

4. The applicant is advised to liaise with the water extraction authorities so that the collection and reuse of surface water is maximised and the reliance on irrigation water from boreholes or the public water supply is minimised.

RESOLVED: That the application be

APPROVED in accordance with the submitted details set out in the supplementary report and the conditions, reasons and informatives set out in the main report of Director of Planning, Transport and Leisure, subject to the following:

RESOLVED: That the application be

REFUSED for the following reasons:

(1) The proposed dwelling by reason of its overall bulk is materially larger than the dwelling being replaced and is harmful by reason of being inappropriate development in the Green Belt and by a detrimental impact on the openness and amenities of the Green Belt. The proposal is contrary to paragraphs 88 and 89 of the National Planning Policy Framework 2012 and policies CP3 and CP14 of the Tonbridge and Malling Borough Core Strategy 2007. There is not considered to be a case of ‘very special circumstances' in justification of the inappropriateness.

(2) The proposed quadruple garage is harmful by reason of being inappropriate development in the Green Belt and by a detrimental impact on the openness and amenities of the Green Belt. The proposal is contrary to paragraphs 88 and 89 of the National Planning Policy Framework 2012 and policies CP3 and CP14 of the Tonbridge and Malling Borough Core Strategy 2007. There is not considered to be a case of ‘very special circumstances' in justification of the inappropriateness.
