Councillors Lettington and Mrs Simpson declared personal and prejudicial interests in Application TM/05/03203/OA in that the applicant was known to them and they withdrew from the meeting during consideration of this item. Decisions were taken on the following applications subject to the prerequisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning and Transportation, or the variations indicated below.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the applications. Speakers are listed under the relevant planning applications shown below.

Listed Building Application for the removal of two semaphore signals from the platforms at Snodland Railway Station, High Street, Snodland.

The application was WITHDRAWN from the agenda.

Listed Building Application: A) Removal of two semaphore signals from station at

RESOLVED: That the application be

APPROVED subject to
(1) the amendment of Condition 11 to read:
11. The development shall not be occupied until the scheme of acoustic protection measures for habitable rooms as described in the Isophon Ltd Report No. R4904-1 dated 28 December 2005 have been installed and shall be retained at all times thereafter.
Reason: To safeguard the aural amenity of the occupiers of the dwelling(s) hereby approved.
(2) the amendment of Condition 12 to read:
12. The details submitted pursuant to Condition 1 shall show details of a scheme for the storage and screening of refuse. The details shall indicate the following:
a. adequate storage provision for two wheeled bins and a recycling box per property adjacent to the building;
b. a collection point to the back edge of the footway adjoining Lunsford Lane.
Refuse bins and recycling receptacles shall only be left at the collection point on the day of collection only and at no other time. The approved scheme shall be implemented before the development is occupied and shall be retained at all times thereafter.
Reason: To facilitate the collection of refuse and preserve visual and residential amenity.

AP3 06/019 TM/05/03518/FL - 40 Upper Mill, East Malling
Two storey rear extension, internal alterations and front porch at 40 Upper Mill, East Malling.

RESOLVED: That the application be

APPROVED subject to
(1) the addition of conditions:
8. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order amending, revoking and re-enacting that Order) no development shall be carried out within Class A, B, C, D and E of Part 1 of Schedule 2 of that Order unless planning permission has been granted on an application relating thereto.
Reason: In the interests of the character of this building and the contribution it makes to the Conservation Area.
9. Prior to the first occupation of the development
a. the remediation scheme approved under reference TM/03/03039/RD shall be fully implemented insofar as it relates to that part of the development which is to be occupied, and
b. a Certificate shall be provided to the Local Planning Authority by a responsible person stating that remediation has been completed and the site is suitable for the permitted end use.
Thereafter no works shall take place within the site such as to prejudice the effectiveness of the approved scheme of remediation.
Reason: In the interests of amenity and public safety.
10. Details of a facsimile replacement chimney shall be submitted to the Local Planning Authority. Upon approval the work shall be carried out in strict accordance with those details prior to occupation of the dwelling and maintained thereafter.
Reason: To ensure that the development does not harm the character and appearance of the existing building or visual amenity of the locality.
(2) the amendment of Informative 3 to read:
3. The details submitted pursuant to condition 6 shall show all details of all windows as timber windows, with multi panes, designed to conservation standards. Advice can be obtained from the case officer.

Revised landscaping details by millpond submitted pursuant to condition 4 of planning permission TM/01/03099/FL: Residential development comprising 63 new build and 2 refurbished dwellings and associated external works, access, landscaping, parking, garaging and traffic management proposals at the former Council Depot, 77, 83, 91 and McNaughtons Yard, Mill Street, East Malling.

RESOLVED: That the application be

DEFERRED for the Council's Health and Safety Officer to make a site inspection of the development.
