MATTERS FOR RECOMMENDATION TO THE COUNCIL
LA 06/004 Housing Act 2004: Licensing of Houses in Multiple Occupation
The report of the Chief Solicitor set out details of the licensing requirements and the administrative implications of the introduction of mandatory licensing of houses in multiple occupation under the provisions of Part 2 and 3 of the Housing Act 2004. The Committee noted that the licensing regime would be effective from 6 April 2006 but that the enforcement provisions would not come into effect until 3 July 2006.

RECOMMENDED: That

(1) authority be delegated to the Chief Solicitor to determine unopposed applications for HMO licences and that opposed applications be considered by the Licensing and Appeals Committee, sitting as a panel; and

(2) the appropriate amendments to Part 3 of the Council's constitution be authorised.
