Councillor Balcombe declared a personal and prejudicial interest in Item TM/11/0156/FL - Land Adjacent to Allotments, Belgrave Street, Eccles in that he was a member of Aylesford Parish Council. He did not withdraw from the meeting on consideration of this item as the decision to defer the application was taken immediately, with no debate or discussion, upon the planning officer's request.

Decisions were taken on the following applications subject to the pre-requisites, informatives, conditions or reasons for refusal set out in the report of the Director of Planning, Transport and Leisure, or in the variations indicated below. Any supplementary reports were tabled at the meeting.

Members of the public addressed the meeting where the required notice had been given and their comments were taken into account by the Committee when determining the application. Speakers are listed under the relevant planning application shown below.

Ground floor side extension, with pitched roof and Velux windows at 213 Robin Hood Lane, Blue Bell Hill, Chatham, Kent.

RESOLVED: That the application be

REFUSED for the following reason:

1. The proposed extension as a whole, and in particular the rear portion abutting the garage of the adjacent neighbour, would have an overbearing impact and be detrimental to the outlook and general amenity of the adjacent dwelling. The application is therefore contrary to Saved Policy P4/12 and its associated annex PA4/12 of the Tonbridge and Malling Borough Local Plan 1998.

AP3 11/056 TM/11/02493/FL - Land Adjoining 260 Wateringbury Road, East Malling
Change of use of the land to static holiday log cabin (caravan) site at land adjoining 260 Wateringbury Road, East Malling, West Malling, Kent.

RESOLVED: That the application be

APPROVED, subject to:

(1) the conditions, reasons and informatives (subject to amendments set out below) as set out in the report of the Director of Planning, Transport and Leisure;

(2) the following amended conditions:

2. No development shall take place until there has been submitted to and approved by the Local Planning Authority a scheme of landscaping and boundary treatment. The scheme shall include additional planting to the northern boundary with The Heath. All planting, seeding and turfing comprised in the approved scheme of landscaping shall be implemented during the first planting season following occupation of the buildings or the completion of the development, whichever is the earlier. Any trees or shrubs removed, dying, being seriously damaged or diseased within 10 years of planting shall be replaced in the next planting season with trees or shrubs of similar size and species, unless the Authority gives written consent to any variation. Any boundary fences or walls or similar structures as may be approved shall be erected before first occupation of the building to which they relate.

Reason: Pursuant to Section 197 of the Town and Country Planning Act 1990 and to protect and enhance the appearance and character of the site and locality.

4. No development shall take place until details of the layout, surfacing and draining of the on-site access roads and vehicle parking areas have been submitted to and approved by the Local Planning Authority. The works shall be carried out in accordance with the approved details before the parking area is brought into use and shall be so retained at all times thereafter.

Reason: To ensure a finish to the access and parking areas is consistent with the character and appearance of the locality and ensures no surface water run off onto land outside the ownership of the applicant.

5. No development shall commence until details of a scheme for the storage of any associated materials and equipment, including any gas bottles and canisters, have been submitted to and approved by the Local Planning Authority. The approved scheme shall be implemented before the development is occupied and shall be retained at all times thereafter.

Reason: To preserve visual amenity.

6. (i) the log cabins (caravans) shall be occupied for holiday purposes only;

(ii) the log cabins (caravans) shall not be occupied as a person's sole, or main place of residence;

(iii) no log cabin (caravan) shall be continuously occupied by the same individual or group of individuals for any period longer than two months;

(iv) the owners/operators shall maintain an up-to-date register of the names of all owners/occupiers of individual log cabin (caravans) on the site, their arrival and departure dates and of their main home addresses, and shall make this information available at all reasonable times to the local planning authority.

Reason: To ensure that the log cabin (caravans) hereby approved are not used for permanent residential occupation;

(3) the following additional conditions:

9. Notwithstanding any of the provisions of Parts 4 and 27 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 (as amended) the site shall not be used for the pitching of tents.

Reason: This would lead to an over intensification of the use of the site.

10. The log cabins (caravans) hereby approved shall not exceed 13m in length and 4m in width unless otherwise agreed in writing by the Local Planning Authority.

Reason: To avoid harm to the character and appearance of the area through over-intensive development.

11. No development shall commence until details of a scheme for the storage and screening of refuse has been submitted to and approved by the Local Planning Authority. The approved scheme shall be implemented before the development is occupied and shall be retained at all times thereafter.

Reason: To facilitate the collection of refuse and preserve visual amenity; and

(4) the following additional informative:

3. With regard to the additional planting on the northern boundary required by condition 2 above, the use of laurel is recommended to provide all year screening.
