Planning Enforcement

Reference was made to the limitations on the considerations that local planning authorities were able to take into account in deciding whether or not it was expedient to take enforcement action. The report accordingly suggested that representations be made to the Government to improve the powers comprised in the regime for planning enforcement.

Following consideration by the Planning and Transportation Advisory Board, the Cabinet Member for Planning and Transportation resolved that:
1) a letter be sent to the Department for Communities and Local Government encouraging the introduction of a new offence of carrying out development without the necessary approvals under planning legislation and also a requirement for independent building control operatives to inform the Local Planning Authority of any discrepancies between approved plans and what is happening on the ground;
2) the letter be copied to the Planning Shadow spokesmen of the Conservative and Liberal Democrat parties and the Local Government Association, encouraging them to support the approach to Government; and
3) the attention of adjoining authorities be drawn to the action taken.
