MATTERS FOR RECOMMENDATION TO THE CABINET
LA 11/058 Sexual Entertainment Venues
The Chief Solicitor presented a report which advised the Committee of the results of the public consultation on the proposed adoption of the sexual entertainment licensing provisions introduced by the Policing and Crime Act 2009. The report set out the results of the consultation exercise with local residents and businesses, and asked Members to recommend to Cabinet that the relevant provisions be adopted.

Members were advised that a draft policy would be submitted to the meeting of the Committee in March 2012, and that the draft policy would be subject to public consultation with a view to adoption by the Committee in May 2012.

RECOMMENDED: That the Council

(1) adopt the sexual entertainment licensing provisions contained in Schedule 3 to the Local Government (Miscellaneous Provisions) Act 1982 (as amended); and

(2) the first appointed day be endorsed as 1 June 2012.
DECISIONS TAKEN UNDER DELEGATED POWERS IN ACCORDANCE WITH PARAGRAPH 3 (OR 2), PART 3 OF THE CONSTITUTION
LA 11/059 Consultation Paper on Proposal to Deregulate Schedule One of the Licensing Act 2003
The Chief Solicitor's report outlined the proposals to deregulate Schedule 1 of the Licensing Act 2003, contained within the consultation paper published by the Department for Culture, Media and Sport. Members' approval was sought for a draft response to the consultation paper.

Members considered it an excellent draft response. They discussed how the response needed to be as robust as possible and were concerned as to the implications of being reduced to a reactive rather than proactive role. There were concerns for public safety and quality of life for affected neighbours. It was noted that the Police thought that the proposed capacity figure of 5,000 should be lowered to 500. The Committee agreed with this and considered an even lower threshold would be more appropriate. A Member also suggested that it might be appropriate to have different capacity threshold for indoor and outdoor events. It was agreed that the final response should also be copied to the local Members of Parliament.

RESOLVED: That

(1) the draft response to the consultation paper be noted; and

(2) the final draft, subject to the comments above, be agreed for submission to the Department for Culture, Media and Sport.
