RESOLVED: That the Minutes of the meeting of the Council held on 19 November 2009 be approved as a correct record and signed by the Mayor.
C 10/003 Mayor's Announcements.
The Mayor advised that, despite the weather conditions over the Christmas period and during January, she had undertaken a number of official duties, visits and activities. She made particular reference to the pantomime 'Aladdin' at the Scott's Project, the Christmas Festival in Snodland, the 40th Anniversary of the Tonbridge Scouts and Guides Pipe and Drum Band and Medway's celebration of the Chinese New Year on 14 February 2010. She thanked Members for their support at the Tonbridge Christmas Festival on 28 November, the Christmas 'Warm-Up' on 4 December and at the 'Call My Bluff' quiz on 22 January 2010.

The Mayor reminded Members of the 'Blues Brothers' concert at Ditton Community Centre on 26 March and her Charity Bike Ride from Tonbridge to Penshurst on 11 April. She advised that tickets for the performance of 'Habeas Corpus' at the Oast Theatre on 21 April 2010 were 'sold out'. She welcomed Members' support of these various events.

C 10/006 Leader's Announcements.
The Leader requested that the Council's thanks be recorded to all of the officers who, due to their outstanding efforts during the bad weather conditions, had maintained the Council's services.

The Leader regretfully announced that the County Council's application to the Government for funding for the enhancement and expansion of the gypsy and traveller site at Coldharbour had been rejected.

The Leader was pleased to advise that one of the young people participating in the Apprenticeship Scheme had been offered a permanent post in Financial Services.

The Leader invited the Cabinet Members to give a brief presentation on activity within each of their portfolios.

C 10/015 Changes to the Constitution to Implement Provisions in Animal Welfare Act 2006
The Monitoring Officer's report set out details of amendments required to the Constitution in order to implement provisions contained in the Animal Welfare Act 2006.

RESOLVED: That the Monitoring Officer be authorised to amend Part 3 of the Constitution to give effect to the changes to the Delegations to the Director of Health and Housing as set out in the report and to amend article 12 in part 2 of the Constitution to refer to "Animal Welfare" in the list of functions and areas of responsibility for the Director of Health and Housing.
C 10/016 Consultation on Draft Statutory Guidance on the Duty to Respond to Petitions
The report of the Chief Executive set out details of a proposed response to the Government's consultation on draft Statutory Guidance on the duty to local authorities to respond to petitions.

RESOLVED: That the Borough Council's response to the consultation on draft statutory guidance on the duty to respond to petitions be submitted based on the comments set out in the report.
C 10/017 Response to Motions
The report of the Chief Executive set out details of the responses received in respect of the resolutions at Minutes C 09/080 and C 09/088 regarding the Disability Discrimination Act and the Distribution of Revenue Support Grant to local authorities.

RESOLVED: That the report be received and noted.
C 10/018 Sealing of Documents
RESOLVED: That authority be given for the Common Seal of the Council to be affixed to any instrument to give effect to a decision of the Council incorporated into the Minutes and proceedings.

C 10/020 Legal Services Review

The report of the Chief Executive set out details of a proposal to share a Chief Solicitor/Legal Services Manager with Sevenoaks District Council. The Council was advised that the proposal built on the effective working relationship which had evolved over the last twelve months and provided opportunities for sharing best practice and to increase resilience. Members noted that the Central Services Director would continue to exercise the role of Monitoring Officer.

RESOLVED: That

(1) the partnership arrangement to share the Legal Services Manager (or such title as shall be agreed) with Sevenoaks District Council from 1 March 2010, be endorsed;

(2) the partnership agreement be initially for a three year period, subject to a six month update report and eighteen month review, both being reported to General Purposes Committee; and

(3) thanks be extended to Ian Henderson for his efforts whilst fulfilling the role of Acting Chief Solicitor.
