The Panel gave consideration to the report of the Director of Central Services and Monitoring Officer regarding an application for a Probationary Private Hire Driver’s Licence.  The Panel was advised that the Applicant had held a Private Hire Driver’s Licence with Maidstone Borough Council for ten years.  The Panel listened carefully to the representations made by the Applicant and his proposed mentor who had accompanied him at the hearing regarding the circumstances which had led to the receipt of a Caution on 4 October 2011.  The Panel expressed disappointment at the Applicant’s failure to disclose the Caution on his application form questionnaire and advised the applicant that it took such matters very seriously.  The Panel stressed the need to formally notify the Licensing Authority of any convictions or cautions and to comply with the conditions applied to Driver’s Licences.  The Panel, therefore

 

RESOLVED:  That the Applicant be granted a Probationary Private Hire Driver’s Licence with Tonbridge and Malling Borough Council subject to

 

1.    the applicant attending a bi-monthly review during the six month probationary period; and

 

2.    a note be made on the applicant’s record that he had failed to disclose the receipt of the Caution and that this should be reported to the Panel in the event of any further breach of conditions.
