The Panel gave consideration to the report of the Director of Central Services and Monitoring Officer regarding an application for a Probationary Private Hire Driver’s Licence following receipt of information from the Disclosure and Barring Service (DBS).  The Panel listened carefully to the representations made by the applicant, had regard to the report of the Director of Central Services and found that

 

(1)          the Tonbridge and Malling Borough Council Hackney Carriage and Private Hire Policy stated that, where offences of dishonesty had been committed, an application would normally be refused if made within 4 years of conviction;

 

(2)          the relevant convictions were on 24 June 2014;

 

(3)          a clear period of time from the date of conviction, with no further problems, was required before an application could be considered favourably and that this position was supported by the Council’s policy; and

 

(4)          whilst the Applicant’s explanation of the offences was noted, the Panel was also concerned that the offences had attracted a custodial sentence. 

 

The Panel, therefore

 

RESOLVED:  That the application for a Probationary Private Hire Driving Licence be refused.
