Further to Minute LA 14/10 the Director of Central Services and Monitoring Officer reported that, unlike tattooing, semi-permanent skin-colouring, cosmetic piercing and electrolysis, acupuncture was dealt with under Section 14 of the Local Government (Miscellaneous Provisions) Act 1982.  He advised that the Council needed to pass a new resolution to ensure that acupuncture was included in the adoption of a new single consolidated set of byelaws.

 

RECOMMENDED:  That

 

(1)       the Council adopt the model byelaws (attached as Appendix 2 to the report) for the regulation of acupuncture, tattooing, semi-permanent skin colouring, cosmetic piercing and electrolysis in accordance with sections 14 and 15 of the Local Government (Miscellaneous Provisions) Act 1982 as amended by section 120 of the Local Government Act 2003 and authorise the Director of Central Services to apply to the Secretary of State for confirmation; and

 

(2)       the relevant registration requirements come into effect from the date on which the byelaws referred to in (1) above are confirmed by the Secretary of State and the current byelaws revoked.

The report of the Director of Central Services and Monitoring Officer outlined the response to a questionnaire sent to current licensed hackney carriage drivers and dual badge holders to gauge their opinion of undertaking an Unmet Demand Survey to determine whether a limit should be placed on the number of licensed hackney carriage vehicles. 

 

RESOLVED:  That the Hackney Carriage and Dual Drivers be advised that the Licensing and Appeals Committee had considered their request and found that there was no compelling case to undertake an unmet demand survey.
