The Panel gave consideration to an application made by Mrs R Buehrlen on 11 February 2015 for a Review of a Premises Licence under Section 51 of the Licensing Act 2003 in relation to the premises known as The Bull Hotel, Bull Lane, Wrotham. 

 

The Panel gave careful consideration to the report of the Director of Central Services and Monitoring Officer, the application for the review set out at Annex 1 to the report and the written representations from the applicant and other parties.  The Panel listened carefully to the representations made in person by the Applicant and her husband and those from Lygia Fontanella and Martin Deadman (The Bull Hotel Owners).  In addition, the Panel was shown a series of short video clips taken by the Applicant. 

 

The Panel was mindful of its obligations under Section 18(3) of the Licensing Act 2003 which stated that, having regard to the relevant representations, the Licensing Authority must take such of the steps set out in s18(4) (if any) as it considered appropriate for the promotion of the licensing objectives.  The Panel also had particular regard to the provisions of the amended guidance issued under Section 182 of the 2003 Act in June 2014. 

 

Having regard to the representations, both written and oral, the Panel considered that it would be appropriate to vary the licence, subject to the imposition of suitable additional conditions in order to promote the licensing objectives.  The Panel therefore

 

RESOLVED:  That the Premises Licence be Granted subject to the mandatory conditions as set out in the Licensing Act 2003, such conditions as are consistent with the operating schedule accompanying the current Premises Licence and the following further conditions

Conditions to be added to the premises licence under Annex 3

 

1.            The Buttery must be fitted with a noise limiting device, to be installed and maintained in accordance with the manufacturer’s instructions;

 

2.            During all live and recorded music events, all amplified equipment must be tied into the noise limiting device;

 

3.            The noise level at which the noise limiting device is to operate shall be set in consultation with an officer from the Council's Environmental Protection team; and

 

4.                  Once set, the noise level shall only be altered by the Designated Premises Supervisor strictly in accordance with the levels agreed under condition 3 above.
