Licensing Act 2003 - Interim Steps Regarding Summary Review of a Premises Licence

The report of the Director of Central Services and Monitoring Officer set out details of a request received from the Chief Officer of Police, Kent Constabulary for a summary review of an existing Premises Licence in accordance with Section 53A of the Licensing Act 2003.  The Panel was advised that a Summary Review allowed interim conditions to be attached to a premises licence and an early review of the licence where the police considered that the premises concerned was associated with serious crime and/or disorder.  The Panel was advised that a new procedure for the review of a premises licence had been introduced after amendments to the Licensing Act 2003 by virtue of sections 21 and 22 of the Violent Crime Reduction Act 2006 and that the new provisions for tackling serious crime or disorder (or both) associated with licensed premises had come into effect on 1 October 2007. 

 

The Panel heard from Kent Police regarding an incident which had occurred at the premises on Saturday, 11 April 2015 and noted that, having received the application from the Chief Officer of Police for a summary review on 16 April 2015, the Licensing Authority had 48 hours within which to consider whether it was necessary to attach interim conditions to the premises licence, with immediate effect, prior to a review of the premises licence to be heard in the Civic Suite at the offices of Tonbridge and Malling Borough Council on Tuesday 2 June 2015 commencing at 1000 hours.  A list of proposed interim conditions was presented to the Panel for its consideration. 

 

Having listened carefully to the representations made by Kent Police and the Designated Premises Supervisor, the Panel

 

RESOLVED:  That the following additional conditions be imposed on Premises Licence Number 12/00153/PREM issued on 22 February 2012

 

1.            CCTV to be working at all times that staff or members of the public are on the premises;

 

2.            CCTV to be fully maintained and in working order at all times that the premises is trading;

 

3.            CCTV images to be downloadable at the request of police by staff on duty;

 

4.            All CCTV images to be kept for a minimum of 30 days;

 

5.            Two SIA door staff to be employed on Friday and Saturday nights from 8pm until all customers are away from the premises;

 

6.            No glasses or bottles permitted to be removed from the premises and beer garden;

 

7.            All customers shall be required to vacate the premises within 30 minutes of the end of hours for the sale of alcohol;

 

8.            Suitable signage shall be in place on the premises advising customers to leave quietly;

 

9.            The CCTV system to be upgraded to a standard acceptable to Kent Police.  This system shall be in place by 1 May 2015;
