There were no declarations of interest made in accordance with the Code of Conduct.

The Panel gave consideration to an application made by Mr L Peek on 14 April 2015 for a Review of a Premises Licence under Section 51 of the Licensing Act 2003 in relation to premises known as The Medway Inn, 2 High Street, Wouldham. 

The Panel gave careful consideration to the report of the Director of Central Services and Monitoring Officer, the application for the review set out at Annex 2 to the report and the written representations received from the applicant and other parties.  The Panel listened carefully to the representations made by the Applicant and those from Mr Michael O’Regan (The Medway Inn premises licence holder).

The Panel was mindful of its obligations under Section 18(3) of the Licensing Act 2003, which stated that, having regard to the relevant representations, the Licensing Authority must take such of the steps set out in s18(4) (if any) as it considers appropriate for the promotion of the licensing objectives. The Panel also had particular regard to the provisions of the amended guidance issued under Section 182 of the 2003 Act in June 2014.

The Panel had regard to the representations, both written and oral, and took into consideration the concessions put forward by Mr Michael O’Regan, being: the use of a sound level meter, moving the smoking area to the rear of the premises, ceasing all live and recorded music by midnight, removal of a bench to the front of the property and the provision of improved signage.  Additionally the Panel considered that when there was live or recorded music all windows and doors should be kept shut and advised that automatic door closures would aid this.  The Panel therefore

RESOLVED:  That, if all these matters were attended to satisfactorily, the Panel would not wish to impose these as formal conditions at this time and, therefore, no changes would be made to the Premises Licence. 

The Chairman to move that the press and public be excluded from the remainder of the meeting during consideration of any items the publication of which would disclose exempt information
