Renewal of a Dual Hackney Carriage and Private Hire Driver's Licence (Case No 02/2016)

Consideration was given to the report of the Director of Central Services and Monitoring Officer regarding an application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence following the receipt of information from the Disclosure and Barring Service (DBS).  The DBS Certificate dated 24 November 2015 had shown a conviction for making a false statement to obtain benefit on 4 October 2010 and 17 February 2011.  It was noted that the date of the conviction was 30 June 2014. 

 

The Panel listened carefully to the information provided by the Applicant, had due regard to the evidence he provided of the circumstances regarding the offence and had regard to the report of the Director of Central Services and Monitoring Officer and to the Tonbridge and Malling Borough Council Hackney Carriage and Private Hire Licensing Policy.  In addition the Panel was mindful of the seriousness of the offences of which the Applicant had been convicted and, therefore,

 

RESOLVED:  That

 

(1)          the application for the renewal of a Dual Hackney Carriage and Private Hire Driver’s Licence be APPROVED; and

 

(2)          12 Penalty Points be given against the new licence to reflect the fact that the Applicant had failed to disclose the two convictions to the Licensing Authority within seven days of the conviction.
