Review of a Private Hire and Hackney Carriage Driver's Licence - Case 005/2024

LGA 1972 Sch 12A Paragraph 1 – Information relating to an indivdual

The Panel is invited to consider what action should be taken in respect of a Private Hire Driver’s Licence.

Minutes:

(Reasons: LGA 1972 – Sch 12A Paragraph 1 and 2 – Information relating to an individual and information which is likely to reveal the identity of an individual).

The Licensing and Appeals Committee, sitting as a Panel was asked to consider whether to grant a Private Hire Driver’s Licence, following receipt of information from the Disclosure and Barring Service (DBS).

When submitting their application, the applicant had declared a caution for Common Assault under the Criminal Justice Act 1998 S. 39 from 21 October 2019.  This was confirmed when the applicant produced their DBS certificate.

The Panel listened to all that the applicant told them and the answers to their questions.  They also took into account the comments made by the applicant’s current employer.  The Panel also gave consideration to the Private Hire licence that the applicant was granted by another authority in 2023 and were satisfied that there had been no issues during that time.

Based on the information provided by the applicant and their employer, the Panel was satisfied that the applicant was a fit and proper person to hold a private hire driver’s licence and that they could properly deviate from the policy.

RESOLVED: That, in respect of Case Number 005/2024, the Private Hire Driver’s Licence be granted for three years and that the applicant be reminded of their obligation to notify the Council of any change to their circumstances in future.
